Edith van Schie<\/strong><\/p>\n\n\n\n<p class=\"\">Als een werkgever gebonden is aan een cao die een loonsverhoging voorschrijft, dan moet hij die doorvoeren. Doet hij dat niet, dan kunnen de werknemers de loonsverhoging vorderen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Het antwoord van Edith van Schie<\/h2>\n\n\n\n<p class=\"\">Is een loonsverhoging altijd verplicht? Dat ligt aan de situatie. Als een werkgever gebonden is aan een cao die een loonsverhoging voorschrijft, dan moet hij die doorvoeren. Doet hij dat niet, dan kunnen de werknemers de loonsverhoging vorderen.<br><br>De vraag is dus eigenlijk: ben je als werkgever gebonden aan een bepaalde cao? In cao\u2019s zelf staat altijd welke ondernemers en\/of werknemers onder die cao vallen. Dat moet dus eerst gecheckt worden. De cao\u2019s waar dat voor geldt, staan op de site van het ministerie van SZW.<\/p>\n\n\n\n<p class=\"\">Als de minister zich niet met de cao heeft bemoeid, dan moet een ondernemer zich er toch aan houden als hij lid is van de werkgeversvereniging- en de werknemer van de vakbond die de cao (mede) hebben afgesproken. Als de werkgever of de werknemer lid is van een cao-partij dan moet de werkgever zich er wel aan houden, maar dan kunnen werknemers dat niet afdwingen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mag de werkgever een cao-verhoging weigeren?<\/h2>\n\n\n\n<p class=\"\">Als de werkgever en werknemer geen lid zijn van een cao-partij is de werkgever niet verplicht om je loon te verhogen. Dit is namelijk niet in de wet vastgelegd.
