Edith van Schie<\/strong><\/p>\n\n\n\n<p>Werknemers&nbsp;moeten zich op grond van&nbsp;<a href=\"https:\/\/hrcenter.nl.brightmine.com\/doc\/407183\" target=\"_blank\" rel=\"noreferrer noopener\">artikel 7:660 BW&nbsp;<\/a>houden aan de voorschriften van de werkgever over het verrichten van de arbeid. Ook de voorschriften die tot doel hebben om de goede orde in de onderneming te bevorderen. Dit wordt het \u2018instructierecht\u2019 van de werkgever genoemd. Het instructierecht laat zien dat de werknemer in gezagsverhouding tot de werkgever staat. Voor het invoeren van regels op grond van het instructierecht is de instemming van de werknemers niet nodig.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Instructies aan de werknemer over alcohol- en drugsbeleid<\/h2>\n\n\n\n<p>In de arbeidsovereenkomst en\/of cao staan allerlei rechten en plichten van de werknemer. Vult de werkgever die rechten en verplichtingen nader in, dan oefent hij zijn instructierecht uit. Naarmate de rechten en de plichten van de werknemer gedetailleerder zijn neergelegd in de arbeidsovereenkomst of de toepasselijke cao, zal er voor de werkgever minder ruimte zijn om instructies te geven. De instructies van de werkgever moeten verder redelijk zijn.<\/p>\n\n\n\n<p>Daarnaast kunnen instructies onder meer betrekking hebben op het dragen van een helm of bedrijfskleding, computer- en internetgebruik, identificatie, een rookverbod of een verbod op het gebruik van alcoholische drank. Veel door de werkgever gegeven instructies vloeien voort uit de arbeidsomstandighedenwetgeving.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Voorbeeldbepaling alcohol- en drugsbeleid<\/h2>\n\n\n\n<p>In een reglement rondom alcohol- en drugsbeleid kun je verschillende mogelijkheden opnemen. Hieronder volgen een aantal voorbeelden van zaken die je kunt meenemen:<\/p>\n\n\n\n<p>1. Het is de werknemer verboden om tijdens de uitoefening van de werkzaamheden onder invloed van alcohol of drugs (verdovende middelen) te zijn, dan wel drugs (verdovende middelen) in het bezit te hebben of deze te verhandelen.<\/p>\n\n\n\n<p>2. Het is werknemers met een leaseauto verboden om te rijden onder invloed van alcohol of drugs (verdovende middelen). De Werkgever adviseert alle overige werknemers om niet te rijden onder invloed van alcohol of drugs (verdovende middelen).<\/p>\n\n\n\n<p>3. Overtreding van deze regels kan leiden tot schorsing of ontslag en bij zware overtreding zelfs tot ontslag op staande voet.<\/p>\n\n\n\n<p>4. Indien de Werknemer een alcohol- of drugsprobleem heeft is de Werkgever zeer bereid om hulp te bieden in de vorm van therapie (ontwenningskliniek of andere instanties) om te ondersteunen in het herstelproces.
