Werkgevers mogen geen onderscheid maken bij de beloning van mannen en vrouwen bij gelijk werk. In de praktijk is dat nog niet altijd het geval, getuige bijvoorbeeld de zaak waarin een bedrijfsjuriste een zaak aanspande tegen&nbsp;Wehkamp, haar werkgever \u2013 en die zij won. In Europa bedraagt de loonkloof nog altijd bijna&nbsp;13%; in Nederland ligt die ongeveer op het Europese gemiddelde.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Wat vinden HR-professionals?<\/h2>\n\n\n\n<p class=\"\">De loonkloof wordt kleiner, maar verdwijnt niet. In 2022 spraken&nbsp;HR-professionals&nbsp;zich uit over de loonkloof in een survey van Brightmine. Veruit de meerderheid (85%) vindt de discussie en aandacht rond het onderwerp helemaal terecht. Bijna de helft (47%) vindt zelfs dat Nederlandse bedrijven hun salarisdata verplicht zouden moeten publiceren, zoals dat bijvoorbeeld in het Verenigd Koninkrijk gebeurt.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Europese richtlijn<\/h2>\n\n\n\n<p class=\"\">Zover is het nog niet, maar&nbsp;nieuwe Europese regels&nbsp;gaat wel die richting uit. Om de loonkloof te verkleinen, kwam de Europese Commissie in 2021 met een plan om bedrijven te verplichten tot meer loontransparantie. Met een grote meerderheid heeft het Europees Parlement op donderdag 30 maart ingestemd met de EU-richtlijn inzake loontransparantie. Deze EU-richtlijn moet zorgen voor openheid over loon. En dat moet er weer aan bijdragen dat de loonkloof tussen mannen en vrouwen in de EU \u2013 die nu bijna 13% is &#8211; wordt verkleind.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Evalueren en rapporteren<\/h2>\n\n\n\n<p class=\"\">Deze richtlijn is erop gericht om grote organisaties (vanaf 100 werknemers) te dwingen om hun beloningsbeleid te evalueren en om jaarlijks te rapporteren over loonverschillen.<\/p>\n\n\n\n<p class=\"\">Werkgevers met 100 werknemers of meer moeten informatie verstrekken over de loonkloof tussen vrouwelijke en mannelijke werknemers in hun organisatie. Zij moeten deze informatie delen met de bevoegde nationale autoriteit en met hun werknemers en de vertegenwoordigers van hun werknemers. Deze evaluatie moet maatregelen bevatten om de ongerechtvaardigde verschillen te verhelpen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Weten wat je collega verdient<\/h2>\n\n\n\n<p class=\"\">Werknemers krijgen bovendien recht op informatie over hun beloning ten opzichte van collega\u2019s. Bij benadeling, kunnen zij eenvoudiger naar de rechter stappen. Om discriminatie te voorkomen moeten werkgevers ervoor zorgen dat hun werknemers op eenvoudige wijze de objectieve en gender neutrale criteria kunnen inzien die worden gebruikt om salarissen en eventuele salarisverhogingen te bepalen. Werknemers en hun vertegenwoordigers moeten informatie kunnen opvragen over hun loonniveau en over de loonniveaus voor werknemers die hetzelfde of gelijkwaardig werk verrichten, uitgesplitst naar geslacht. Daarnaast moeten werkgevers aangeven welk loon of welke loonschaal aan toekomstige werknemers wordt betaald.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sollicitanten vooraf informeren<\/h2>\n\n\n\n<p class=\"\">Verder moeten werkgevers sollicitanten vooraf informatie geven over het aanvangssalaris \u00e9n mogen zij sollicitanten niet meer vragen naar hun huidige salaris.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Compensatie en andere rechtsmiddelen<\/h2>\n\n\n\n<p class=\"\">Als werkgevers zich niet houden aan het beginsel van gelijk loon voor gelijk werk, dan hebben hun werknemers het recht om compensatie te eisen.
