In onze cao is geregeld dat zieke werknemers in de eerste zes maanden van hun ziekte 100% van hun loon doorbetaald krijgen. In de zevende maand van de ziekte hoeft nog maar 85% van het loon aan de zieke werknemer te worden betaald. En vanaf de dertiende maand hebben zieke werknemers aanspraak op 70% van hun loon. Wij hebben onze medewerker in juni wel laten weten dat zijn loon vanaf juli naar 85% gaat, maar administratief is dat per ongeluk niet verwerkt. Kunnen we het teveel betaalde loon terugvorderen en overgaan naar 85% loonbetaling?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Het antwoord van Edith van Schie<\/h2>\n\n\n\n<p class=\"\">Ja, in dit geval kan beide. Het is duidelijk dat de werknemer wist dat zijn loon vanaf juli lager zou zijn. Hij heeft daarover immers een brief ontvangen. Duidelijk is dus ook dat de werknemer wist dat hij vanaf juli teveel loon heeft ontvangen. Dat betekent dat de werkgever zowel het teveel betaalde loon vanaf juli van de werknemer mag terugvorderen, als dat hij de loonbetalingen per direct mag terugbrengen tot 85%.<\/p>\n\n\n\n<p class=\"\">Als de werknemer niet was ge\u00efnformeerd en ook anderszins niet had kunnen weten dat zijn loon na een half jaar ziekte zou worden aangepast, dan was het een ander verhaal geweest. Waarschijnlijk had de werkgever het teveel betaalde loon in dat geval niet mogen terugvorderen omdat de werknemer erop vertrouwde dat zijn loonbetalingen klopten.
