Dat is natuurlijk&nbsp; prima, maar wij moeten ons bedrijf natuurlijk ook beschermen. Daarom hebben we een concurrentiebeding en een relatiebeding in onze arbeidscontracten staan, maar kan ik mijn werknemers ook verbieden om na hun uitdiensttreding mijn medewerkers te werven voor indiensttreding bij hen?<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">De HR-vraag van de week<\/h2>\n\n\n\n<p>Ja, dat kan. Dat heet een anti-wervingsbeding of poachingbeding (poaching betekent \u201cstroperij\u201d) en wordt ook wel anti-ronselbeding of aftroggelbeding genoemd. Waar het op neerkomt is dat de werkgever in de arbeidsovereenkomst opneemt dat het de werknemer verboden is om voor een bepaalde periode na het einde van zijn arbeidsovereenkomst werknemers van de werkgever te werven. Dit beding is net zo\u2019n soort beding als een concurrentie- en relatiebeding. Voor dit soort bedingen gelden dan ook dezelfde regels. Het beding kan dus alleen met een meerderjarige werknemer overeengekomen worden. Het beding moet schriftelijk overeengekomen worden.<\/p>\n\n\n\n<p>Als een werkgever dit soort bedingen in een tijdelijke arbeidsovereenkomst wil opnemen, dan kan dat alleen als hij daar een zwaarwegend bedrijfs- of dienstbelang bij heeft. Hij zal dat belang in het beding zelf moeten noemen en moeten motiveren waarom dat belang in deze specifieke situatie bij deze specifieke werknemer aanwezig is, anders geldt het beding niet.
