Het wetsvoorstel &#8216;Wet verbetering zekerheid flexibele arbeidskrachten&#8217; raakt de kern van hoe we omgaan met flexibele arbeid. Van het afschaffen van nulurencontracten tot betere bescherming voor uitzendkrachten, de impact op werkgevers \u00e9n werknemers is aanzienlijk.<\/p>\n\n\n\n<p class=\"\">Maar wat betekenen deze veranderingen concreet voor jouw organisatie? Nieuwe regels voor oproepkrachten<\/h3>\n\n\n\n<p class=\"\">Een van de meest ingrijpende veranderingen is het verdwijnen van nulurencontracten. Deze worden vervangen door basiscontracten waarin een minimumaantal uren wordt vastgelegd. Dit betekent dat werkgevers verplicht worden om hun werknemers niet alleen in te roosteren voor deze uren, maar ook daadwerkelijk uit te betalen. Deze verandering biedt oproepkrachten meer financi\u00eble zekerheid en een beter voorspelbaar werkpatroon.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Betere positie voor uitzendkrachten<\/h3>\n\n\n\n<p class=\"\">De wet introduceert belangrijke verbeteringen voor uitzendkrachten. Zij krijgen recht op hetzelfde salaris als werknemers die vergelijkbaar werk doen binnen het bedrijf waar ze zijn gedetacheerd. Dit principe van &#8216;gelijk loon voor gelijk werk&#8217; wordt uitgebreid met gelijke behandeling op andere gebieden, zoals overwerktoeslagen, ploegentoeslagen.<\/p>\n\n\n\n<p class=\"\">Daarnaast worden de uitzendfases aangepast:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Fase A wordt ingekort van 78 naar 52 weken<\/li>\n\n\n\n<li class=\"\">Fase B verandert van zes contracten in vier jaar naar zes contracten in twee jaar<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Deze aanpassingen zorgen ervoor dat uitzendkrachten sneller zekerheid krijgen over hun arbeidspositie.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Aanpak van draaideurconstructies<\/h3>\n\n\n\n<p class=\"\">Om te voorkomen dat werkgevers constructies gebruiken om vaste contracten te ontwijken, wordt de onderbrekingstermijn drastisch verlengd. Waar werkgevers nu na zes maanden opnieuw een tijdelijk contract kunnen aanbieden, wordt deze termijn verlengd naar vijf jaar. Deze regel geldt straks ook voor de fases A en B bij uitzendwerk.<\/p>\n\n\n\n<p class=\"\">Er komen wel uitzonderingen voor specifieke groepen:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Scholieren en studenten met een bijbaan krijgen te maken met aangepaste regels<\/li>\n\n\n\n<li class=\"\">Voor seizoensarbeid blijft maatwerk mogelijk via cao-afspraken, met een onderbrekingstermijn van drie maanden voor functies die maximaal negen maanden per jaar worden uitgevoerd<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-primary-white-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-0fd240ca wp-block-group-is-layout-constrained\" style=\"margin-top:0;margin-bottom:0;padding-top:var(--wp--preset--spacing--40);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--40);padding-left:var(--wp--preset--spacing--30)\">\n<h2 class=\"wp-block-heading\">Kritische kanttekeningen van de Raad van State<\/h2>\n\n\n\n<p class=\"\">De Raad van State heeft belangrijke bedenkingen bij het wetsvoorstel. Hij betwijfelt of de voorgestelde maatregelen effectief zullen zijn in het aanpakken van structurele arbeidsmarktproblemen.
