Deze uitspraak bouwt voort op het eerdere Deliveroo-arrest uit 2023, waarin een toetsingskader werd gegeven voor het beoordelen van arbeidsrelaties.<\/p>\n\n\n\n<p class=\"\">Belangrijke beoordelingscriteria zijn onder meer:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">De aard en duur van het werk<\/li>\n\n\n\n<li class=\"\">Hoe werkzaamheden en werktijden worden bepaald<\/li>\n\n\n\n<li class=\"\">De inbedding in de organisatie<\/li>\n\n\n\n<li class=\"\">Of het werk persoonlijk moet worden uitgevoerd<\/li>\n\n\n\n<li class=\"\">Hoe het contract is geregeld<\/li>\n\n\n\n<li class=\"\">De wijze van beloning<\/li>\n\n\n\n<li class=\"\">De hoogte van de beloning<\/li>\n\n\n\n<li class=\"\">Het commerci\u00eble risico<\/li>\n\n\n\n<li class=\"\">Het gedrag als ondernemer in het economisch verkeer<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Die omstandigheden moet je allemaal, in onderling verband, bekijken. De HR heeft geen rangorde aangebracht in de genoemde criteria. Het is dus bijvoorbeeld niet belangrijker hoe de werktijden geregeld zijn dan hoe er beloond wordt. Je moet naar alle omstandigheden kijken. Dit noem je een holistische toets.<\/p>\n\n\n\n<p class=\"\">De Uber-zaak draait om een aantal vragen. Een van die vragen is \u2013 kort gezegd \u2013&nbsp;of de Uber-chauffeurs gezien moeten worden als werknemers (met een arbeidsovereenkomst) of opdrachtnemers (met een opdrachtovereenkomst).<\/p>\n\n\n\n<p class=\"\">In de Uber-zaak beantwoordt de Hoge Raad vragen over het negende criterium uit het Deliveroo-arrest, &#8216;ondernemerschap&#8217;. Dit heeft verstrekkende gevolgen: twee personen die precies hetzelfde werk doen voor hetzelfde bedrijf, kunnen anders geclassificeerd worden. Als de ene zich als ondernemer gedraagt in het economisch verkeer (bijvoorbeeld door ook voor anderen te werken, actief aan acquisitie te doen en een eigen bedrijfsreputatie op te bouwen) en de andere niet, kan dit betekenen, dat de eerste als opdrachtnemer en de tweede als werknemer moet worden beschouwd.<\/p>\n\n\n\n<p class=\"\">Deze uitspraak heeft mogelijk impact op het wetsvoorstel Vbar. In dit wetsvoorstel wordt ondernemerschap pas relevant geacht als andere beoordelingscriteria in evenwicht zijn &#8211; een duidelijk verschil met de holistische benadering van de Hoge Raad. Minister van Hijum heeft aangegeven de Uber-uitspraak mee te willen nemen in het wetgevingstraject, en de VVD werkt volgens Kamerlid Thierry Aartsen aan een nieuw wetsvoorstel vanwege de onduidelijkheid in de markt.<\/p>\n\n\n\n<p class=\"\">De Belastingdienst heeft verschillende documenten opgesteld, waaronder de &#8216;Toelichting beoordeling arbeidsrelaties&#8217; en de &#8216;Handleiding bedrijfsbezoeken en boekenonderzoeken&#8217;.
