Dit betekent dat de toelatingsplicht per 1 januari 2028 geldt. Uitzendbureaus moeten de aanvraag voor certificering indienen voor 1 juli 2027. Daartoe introduceert het wetsvoorstel een certificeringsplicht voor uitzendbureaus. Dit houdt in dat het vanaf 2028 niet meer is toegestaan om in Nederland arbeidskrachten ter beschikking te stellen zonder toelating. Alleen bedrijven die in een openbaar register staan, mogen nog werknemers uitlenen. Dit heet de toelatingsplicht.<\/p>\n\n\n\n<p class=\"\">Om toegelaten te worden tot het nieuwe stelsel moeten uitleners voldoen aan deze voorwaarden:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"\">zij moeten een verklaring omtrent het gedrag (VOG) kunnen tonen;<\/li>\n\n\n\n<li class=\"\">zij moeten een waarborgsom overmaken; en<\/li>\n\n\n\n<li class=\"\">zij moeten laten zien dat ze voldoen aan alle relevante wetgeving.<\/li>\n<\/ol>\n\n\n\n<p class=\"\">In het wetsvoorstel staan diverse overgangsmaatregelen. Zo komt er een overgangsregeling waarmee uitleners eenmalig toelating kunnen vragen met het SNA-keurmerk van Stichting Normering Arbeid. Deze overgangsregeling is tijdelijk. De einddatum wordt nog bekend gemaakt.<\/p>\n\n\n\n<p class=\"\">Er zal periodiek worden gecontroleerd of de uitleners nog aan alle eisen voldoen. Zij zijn vanaf 1&nbsp;januari 2028 verplicht om te controleren of de uitleners met wie ze werken zijn toegelaten. De inlener kan dat controleren via het openbare register van toegelaten uitleners. In het geval van doorlening is de inlener \u00f3\u00f3k in overtreding als de werkgever waarbij de arbeidskracht in dienst is, niet is toegelaten.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Toezicht op inleners en uitleners door Arbeidsinspectie<\/h2>\n\n\n\n<p class=\"\">De Nederlandse Arbeidsinspectie houdt toezicht op de verplichtingen voor in- en uitleners. Om dit te handhaven breidt de Nederlandse Arbeidsinspectie haar capaciteit uit. Overtreding van het uitleen- en inleenverbod wordt door de Nederlandse Arbeidsinspectie bestraft met boetes.<\/p>\n\n\n\n<p class=\"\">Het wetsvoorstel is aangenomen in de Tweede Kamer en ligt nu ter behandeling in de Eerste Kamer.
