This\u00a0April, the challenges for HR include: the introduction of carer&#8217;s leave; reforms to the right to request flexible working; and\u00a0updated rules on timing and notice to take paternity leave.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"april-1-comply\">1&nbsp;April: Comply with national minimum wage rises<\/h2>\n\n\n\n<p class=\"\">The rates of the national minimum wage increase on 1&nbsp;April 2024, including an increase of the main national minimum wage (the national living wage) from \u00a310.42 to \u00a311.44.<\/p>\n\n\n\n<p class=\"\">In addition, the national living wage is extended to apply to workers aged 21 and over for pay reference periods beginning on or after 1&nbsp;April 2024. (For pay reference periods beginning before this date, the national living wage rate applies to those aged 23 and over.)<\/p>\n\n\n\n<p class=\"\">Employers should check their pay rates against the new minimum wage rates to ensure that, where necessary, they increase remuneration for the first pay reference period beginning on or after 1&nbsp;April 2024.<\/p>\n\n\n\n<p class=\"\">Employers must also ensure that workers are paid at least the minimum rate for the age band into which they fall. These&nbsp;changes&nbsp;should be reflected in both their holiday policies and contractual arrangements with workers.<\/p>\n\n\n\n<p class=\"\">The key&nbsp;change&nbsp;is that holiday entitlement for irregular hours workers and part-year workers is calculated using an accrual method. The key&nbsp;changes&nbsp;are:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Making the statutory right to request flexible working a &#8220;day one&#8221; right.<\/li>\n\n\n\n<li class=\"\">Giving employees the right to make two requests, rather than one, in a 12-month period.<\/li>\n\n\n\n<li class=\"\">Removing the requirement for an employee to explain what effect, if any, their request would have on the employer and how that might be dealt with.<\/li>\n\n\n\n<li class=\"\">Requiring employers to deal with to a request within two months, rather than three months.<\/li>\n\n\n\n<li class=\"\">Placing an obligation on an employer to consult with an employee before rejecting a request.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Employers should review their flexible working policies to ensure that they reflect the new requirements. The&nbsp;changes&nbsp;mean that, where the expected week of childbirth is after 6&nbsp;April 2024:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Employees are entitled to split their leave into two separate blocks of one week, instead of having to take it all in one period.<\/li>\n\n\n\n<li class=\"\">Paternity leave can be taken within 52 weeks of the child&#8217;s birth \u2014 previously, the leave had to be taken within the first&nbsp;eight&nbsp;weeks.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Under the new procedure, employers must ensure that an employee who wishes to take paternity leave provides their employer, at least 15 weeks before the expected week of childbirth, with a notice of entitlement and a written declaration that they meet the eligibility requirements to take paternity leave.<\/p>\n\n\n\n<p class=\"\">In addition, the new rules mean that an employee who wishes to take paternity leave must give their employer:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Further notice specifying when they wish to start their paternity leave; and<\/li>\n\n\n\n<li class=\"\">A written declaration that the leave will be used to care for a child or support the child&#8217;s mother.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">This is known as a period of leave notice. Also, the protection is extended to those who have recently returned to work from maternity leave, as well as those who have recently returned from adoption leave and a period of six weeks or more shared parental leave.<\/p>\n\n\n\n<p class=\"\">HR needs to ensure that their redundancy process takes account of the extended redundancy protection period where any employees are pregnant or have recently returned to work from maternity, adoption or shared parental leave.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"essential-resources-6\">Essential resources<\/h3>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\"><a href=\"https:\/\/hrcentre.uk.brightmine.com\/policies-and-procedures\/redundancy-policy\/26416\/\">Example redundancy policy<\/a><\/li>\n\n\n\n<li class=\"\"><a href=\"https:\/\/hrcentre.uk.brightmine.com\/letters-and-forms\/redundancy-letter-offering-suitable-alternative-vacancy-to-pregnant-employee-informs-employer-of-pregnancy-on-or-after-6-april-2024-\/167084\/\">Redundancy: Example letter offering suitable alternative vacancy to pregnant employee (informs employer of pregnancy on or after 6&nbsp;April 2024)<\/a><\/li>\n\n\n\n<li class=\"\"><a href=\"https:\/\/hrcentre.uk.brightmine.com\/letters-and-forms\/redundancy-during-or-after-maternity-leave-letter-offering-suitable-alternative-vacancy-to-employee-statutory-maternity-leave-ends-on-or-after-6-april-2024-\/167100\/\">Redundancy during or after maternity leave: Letter offering suitable alternative vacancy to employee (statutory maternity leave ends on or after 6&nbsp;April 2024)<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"april-6-7-increase\">6\/7&nbsp;April: Increase statutory sick pay and family-related pay<\/h2>\n\n\n\n<p class=\"\">The weekly rate of statutory sick pay increases on 6&nbsp;April 2024. The new rate is \u00a3116.75, up from \u00a3109.40.<\/p>\n\n\n\n<p class=\"\">The weekly rates of statutory maternity, adoption, paternity, shared parental and parental bereavement pay increase to \u00a3184.03, up from \u00a3172.48. The deadline is&nbsp;<strong>30 March&nbsp;2024<\/strong>&nbsp;for public-sector employers and&nbsp;<strong>4&nbsp;April 2024<\/strong>&nbsp;for private-sector and voluntary-sector employers.<\/li>\n\n\n\n<li class=\"\">On<strong> 4&nbsp;April 2024<\/strong>, various&nbsp;<a href=\"https:\/\/hrcentre.uk.brightmine.com\/employment-law-guide\/immigration-rules-and-right-to-work\/20347\/\">amendments to the immigration rules<\/a>&nbsp;take effect. These include&nbsp;changes&nbsp;to the salary thresholds for skilled worker visas, global mobility visas, and scale-up visas.<\/li>\n\n\n\n<li class=\"\">On&nbsp;<strong>6&nbsp;April 2024<\/strong>, the&nbsp;<a href=\"https:\/\/hrcentre.uk.brightmine.com\/employment-law-guide\/unfair-dismissal\/20428\/\">employment&nbsp;tribunal award limits<\/a>&nbsp;increase. These include the basic award for unfair dismissal going up from \u00a37,836 to \u00a38,533 and the compensatory award for unfair dismissal going up from \u00a3105,707 to \u00a3115,115.<\/li>\n\n\n\n<li class=\"\">On&nbsp;<strong>8&nbsp;April 2024<\/strong>, the&nbsp;<a href=\"https:\/\/hrcentre.uk.brightmine.com\/employment-law-guide\/state-pension\/156317\/\">basic state pension<\/a>&nbsp;increases from \u00a3156.20 to \u00a3169.50 and the new state pension\/single-tier pension will increase from \u00a3203.85 to
