This marks the fourth step in the&nbsp;<a href=\"https:\/\/www.reginfo.gov\/public\/reginfo\/Regmap\/REG_MAP_2020.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">nine-step federal regulatory process<\/a>.<\/p>\n\n\n\n<p class=\"\">The scope of the proposed rule appears to have expanded as well. When the rule was first added to the DOL&#8217;s regulatory agenda last fall, it was titled&nbsp;<em>Employee or Independent Contractor Classification Under the Fair Labor Standards Act<\/em>. Now that it&#8217;s at the White House, the title also includes the&nbsp;<a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/independent-contractors-federal\/266\/#the-family-and\" target=\"_blank\" rel=\"noreferrer noopener\">Family and Medical Leave Act (FMLA)<\/a>&nbsp;and the&nbsp;<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/agriculture\/mspa\" target=\"_blank\" rel=\"noreferrer noopener\">Migrant and Seasonal Agricultural Worker Protection Act<\/a>.<\/p>\n\n\n\n<p class=\"\">Earlier, the DOL said it plans to repeal the&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/01\/10\/2024-00067\/employee-or-independent-contractor-classification-under-the-fair-labor-standards-act\" target=\"_blank\" rel=\"noreferrer noopener\">current FLSA independent contractor rule<\/a>&nbsp;enacted in 2024 under the Biden administration and consider &#8220;how it will proceed with respect to independent contractor classification.&#8221;<\/p>\n\n\n\n<p class=\"\">One possibility is that the DOL will restore the&nbsp;<a href=\"https:\/\/hrcenter.us.brightmine.com\/legal-timetable\/flsa-independent-contractor-rule-takes-effect\/47861\/\" target=\"_blank\" rel=\"noreferrer noopener\">independent contractor rule<\/a>&nbsp;that the Trump administration put forward in 2020, or some variation thereof.<\/p>\n\n\n\n<p class=\"\">In the meantime, the DOL has stopped enforcing the Biden-era rule; instead, it&nbsp;<a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/WHD\/fab\/fab2025-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">directed<\/a>&nbsp;its personnel to apply a more business-friendly&nbsp;<a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/WHD\/fab\/fab2025-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">2008 fact sheet<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/WHD\/opinion-letters\/FLSA\/FLSA2019-6.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">2019 opinion letter<\/a>&nbsp;when investigating misclassification cases.<\/p>\n\n\n\n<p class=\"\">In preparation for a new rule, employers may wish to revisit the 2020 rule to see if any workers currently classified as employees might be reclassified as independent contractors under a more relaxed FLSA standard. Of course, employers also should consider any relevant independent contractor tests under&nbsp;<a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/independent-contractors-federal\/266\/#common-law-right\" target=\"_blank\" rel=\"noreferrer noopener\">common law<\/a>, the&nbsp;<a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/independent-contractors-federal\/266\/#under-the-tax\" target=\"_blank\" rel=\"noreferrer noopener\">federal tax code<\/a>,&nbsp;<a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/independent-contractors-federal\/266\/#under-other-laws\" target=\"_blank\" rel=\"noreferrer noopener\">other federal laws<\/a>&nbsp;and miscellaneous&nbsp;<a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/types-of-employers-and-workers\/independent-contractors\/#stateRequirementsSection\"
