{"id":12155,"date":"2026-01-26T08:40:06","date_gmt":"2026-01-26T13:40:06","guid":{"rendered":"https:\/\/www.brightmine.com\/us\/?post_type=resources&#038;p=12155"},"modified":"2026-02-19T08:54:36","modified_gmt":"2026-02-19T13:54:36","slug":"maine-passes-employer-surveillance-law","status":"publish","type":"resources","link":"https:\/\/www.brightmine.com\/us\/resources\/hr-compliance\/employee-privacy\/maine-passes-employer-surveillance-law\/","title":{"rendered":"Maine passes employer surveillance law"},"content":{"rendered":"\n<div class=\"wp-block-group alignwide has-primary-white-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-b5fc8583 wp-block-group-is-layout-constrained\" style=\"border-radius:25px;padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-7fc3d43a wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:70%\">\n<div class=\"wp-block-group is-vertical is-layout-flex wp-container-core-group-is-layout-8e1436f2 wp-block-group-is-layout-flex\" style=\"margin-top:0;margin-bottom:0\">\n<p class=\"\">by <strong>Michael Cardman,<\/strong> Brightmine Senior Legal Editor<\/p>\n<\/div>\n\n\n\n<p class=\"\">Employers in Maine that monitor workers through computers, phones and other devices will soon face new requirements.<\/p>\n\n\n\n<p class=\"\">Signed into law earlier this month and taking effect 90 days after the current legislative session ends,&nbsp;<a href=\"https:\/\/legislature.maine.gov\/legis\/bills\/getPDF.asp?paper=HP0025&amp;item=3&amp;snum=132\" target=\"_blank\" rel=\"noreferrer noopener\">LD 61<\/a>&nbsp;will prohibit employers from using&nbsp;<em>employer surveillance&nbsp;<\/em>unless they:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Notify employees beforehand;<\/li>\n\n\n\n<li class=\"\">Refrain from using audiovisual monitoring in an employee&#8217;s residence, personal vehicle or property unless the monitoring is required by the employee&#8217;s job duties;<\/li>\n\n\n\n<li class=\"\">Inform prospective employees during the employment interview process that the employer engages in employer surveillance;<\/li>\n\n\n\n<li class=\"\">Provide written notice at least once per calendar year to all current employees that the employer engages in employer surveillance; and<\/li>\n\n\n\n<li class=\"\">Allow employees to decline requests to install data-collection or -transmission applications on their personal electronic devices for surveillance purposes.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">The law defines&nbsp;<em>employer surveillance<\/em>&nbsp;as &#8220;the monitoring of an employee by an employer through the use of an electronic device or system, including but not limited to the use of a computer, telephone, wire or radio or an electromagnetic, photoelectronic or photo- optical system.&#8221; Excluded from this definition are surveillance cameras for security or safety purposes and the use of global positioning system (GPS) tracking or other safety devices on employer-provided vehicles.<\/p>\n\n\n\n<p class=\"\">Employers that violate the new law will be subject to fines of $100-$500 for each violation.<\/p>\n\n\n\n<p class=\"\">&#8220;The use of surveillance technology for safety reasons is one thing,&#8221; said the bill&#8217;s sponsor, state Rep. Amy Roeder. &#8220;But employers using this technology to monitor productivity and track the performance of their employees is an overreach. I am proud that the Legislature agrees that we need these common-sense protections in place for Maine workers, especially during this time when monitoring technology is pervasive and intrusive.&#8221;<\/p>\n\n\n\n<p class=\"\">Business groups oppose the new law. &#8220;While we understand and support the goal of protecting employee privacy, LD 61 would significantly interfere with employers&#8217;
