Abigail Spanberger has signed into law legislation (<a href=\"https:\/\/lis.virginia.gov\/bill-details\/20261\/HB1092\" target=\"_blank\" rel=\"noreferrer noopener\">HB 1092<\/a>&nbsp;in the House of Delegates and&nbsp;<a href=\"https:\/\/lis.virginia.gov\/bill-details\/20261\/SB288\" target=\"_blank\" rel=\"noreferrer noopener\">SB 288<\/a>&nbsp;in the Senate) that tasks the Virginia Safety and Health Codes Board with adopting regulations by May 1, 2028, that will require employers to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">Provide employees who are working in heat with:\n<ul class=\"wp-block-list\">\n<li class=\"\">Water,<\/li>\n\n\n\n<li class=\"\">Access to shade or climate-controlled environments when practicable,<\/li>\n\n\n\n<li class=\"\">Rest periods, and<\/li>\n\n\n\n<li class=\"\">Acclimatization to working in heat,&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li class=\"\">Provide effective training regarding heat-illness prevention;<\/li>\n\n\n\n<li class=\"\">Implement heat and high-heat procedures when the temperature exceeds certain thresholds; and<\/li>\n\n\n\n<li class=\"\">Establish effective emergency-response procedures.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">These regulations will include exemptions for certain emergency services and for short periods of heat exposure lasting no more than 15 consecutive minutes.<\/p>\n\n\n\n<p class=\"\">In developing the regulations, the Board is required to consider its&nbsp;<a href=\"https:\/\/www.doli.virginia.gov\/wp-content\/uploads\/2021\/08\/17-PRO1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">draft heat-illness prevention standard from 2021<\/a>. Among other things, that draft standard proposed setting the threshold for&nbsp;<em>heat&nbsp;<\/em>at 80 degrees Fahrenheit and for&nbsp;<em>high heat<\/em>&nbsp;at 90 degrees Fahrenheit, which would trigger additional requirements such as 10-minute cooldown rest periods every two hours.<\/p>\n\n\n\n<p class=\"\">Virginia follows in the footsteps of several other states that have enacted heat-illness prevention requirements in recent years, including&nbsp;California,&nbsp;Colorado&nbsp;(for agricultural employees),&nbsp;Minnesota,&nbsp;Oregon&nbsp;and&nbsp;Washington.
