Weisenfeld<\/strong><\/p>\n\n\n\n<p>The Supreme Court&#8217;s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/20-1199_l6gn.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">landmark 6-3 decision<\/a> last week to strike down race-based admissions programs in higher education has far-reaching implications. And despite the focus on those admissions programs at Harvard and the University of North Carolina specifically, the impact cannot help but extend to the workplace.<\/p>\n\n\n\n<p>That&#8217;s why more than 80 corporations and business groups joined forces to file amicus briefs in these joint cases in support of the universities with a veritable who&#8217;s who of big names involved, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li>Apple.<\/li>\n\n\n\n<li>General Electric.<\/li>\n\n\n\n<li>Google.<\/li>\n\n\n\n<li>Intel.<\/li>\n\n\n\n<li>IKEA.<\/li>\n\n\n\n<li>Salesforce.<\/li>\n\n\n\n<li>United Airlines.<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-group has-alabaster-gray-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-80fb368b wp-block-group-is-layout-constrained\" style=\"border-bottom-left-radius:25px;border-bottom-right-radius:25px;padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\">\n<p>In one of those briefs, the <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-1199\/232357\/20220801135424028_Nos.%2020-1199%2021-707%20-%20Brief%20for%20Major%20American%20Business%20Enterprises%20Supporting%20Respondents.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">companies argued<\/a> that these admissions programs using race as a &#8220;plus factor&#8221; in admissions should continue because they create a pipeline of highly qualified future workers and business leaders.<\/p>\n<\/div>\n\n\n\n<p>But the Supreme Court&#8217;s holding made clear that these programs were unconstitutional under the Equal Protection Clause of the 14th Amendment. Writing for the Court, Chief Justice John Roberts said, &#8220;Eliminating racial discrimination means eliminating all of it.&#8221;<\/p>\n\n\n\n<p>Addressing the diversity argument, he noted that remedying societal discrimination is not a compelling interest that justifies race-based state action. And as Equal Employment Opportunity Commission (EEOC) Chair Charlotte Burrows noted, it&#8217;s not hard to connect the dots for how this result could impact employers.<\/p>\n\n\n\n<p>&#8220;That&#8217;s a problem for our economy because businesses often rely on colleges and universities to provide a diverse pipeline of talent for recruitment and hiring,&#8221; said Burrows <a href=\"https:\/\/www.eeoc.gov\/newsroom\/statement-eeoc-chair-charlotte-burrows-supreme-court-ruling-college-affirmative-action\" target=\"_blank\" rel=\"noreferrer noopener\">in a statement<\/a>. &#8220;Diversity helps companies <a href=\"https:\/\/www.brightmine.com\/us\/solutions\/attract-retain-talent\/\">attract top talent<\/a>, sparks innovation, improves employee satisfaction, and enables companies to better serve their customers.&#8221;<\/p>\n\n\n\n<p>Justice Sonia Sotomayor went even further in a lengthy and pointed dissent. &#8220;The devastating impact of this decision cannot be overstated,&#8221; she wrote. While Justice Sotomayor understandably focused on what the result will mean for racial inequity in higher education, the employment landscape was not far from her mind either.<\/p>\n\n\n\n<p>She noted, for instance, that &#8220;stark racial disparities exist in unemployment rates.&#8221; Justice Sotomayor also wrote that the Supreme Court majority is creating a leadership pipeline that is less diverse than our increasingly diverse society.<\/p>\n\n\n\n<p>So, will this ruling sound a death knell for <a href=\"https:\/\/www.brightmine.com\/us\/resources\/guides-how-to\/how-to-develop-a-dei-strategy\/\">corporate diversity, equity and inclusion (DEI) programs<\/a>?<\/p>\n\n\n\n<div class=\"wp-block-group alignfull has-secondary-light-gray-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-fcdab8bb wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30);padding-top:var(--wp--preset--spacing--40);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--40);padding-left:var(--wp--preset--spacing--30)\">\n<h2 class=\"wp-block-heading has-text-align-center has-large-font-size\">Want to make smarter, more-informed decisions?<\/h2>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-a89b3969 wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button has-custom-font-size\" style=\"font-size:clamp(14px, 0.875rem + ((1vw - 3.2px) * 0.274), 16px);font-style:normal;font-weight:500\"><a class=\"wp-block-button__link has-secondary-blue-color has-primary-white-background-color has-text-color has-background has-link-color wp-element-button\" href=\"\/us\/products\/hr-compliance-center\/\" style=\"border-radius:100px\">Learn more<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"states-are-watching-closely\">States are watching closely<\/h2>\n\n\n\n<p>While the Supreme Court did not address diversity in the workplace directly, its ruling undoubtedly may embolden some states to take further aim at DEI initiatives. Earlier this year, the office of Texas Gov. Greg Abbott <a href=\"https:\/\/hrcenter.us.brightmine.com\/news\/diversity-hiring-initiatives-are-illegal-texas-governors-office-says\/52232\/\" target=\"_blank\" rel=\"noreferrer noopener\">warned state agencies in the Lone Star State<\/a> not to use DEI initiatives in hiring.<\/p>\n\n\n\n<p>In 2022, a Florida law known as the Stop WOKE Act placed limits on the content of workplace diversity and inclusion training. While a judge later <a href=\"https:\/\/hrcenter.us.brightmine.com\/news\/floridas-stop-woke-act-is-blocked\/51904\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked enforcement of the law<\/a> as it applied to private employers, the Supreme Court&#8217;s broad ruling could spark renewed efforts to impose further limits.<\/p>\n\n\n\n<div class=\"wp-block-group has-primary-white-color has-secondary-blue-background-color has-text-color has-background has-link-color wp-elements-1348fe9f32b663f064600c44a56368a2 is-layout-flow wp-block-group-is-layout-flow\" style=\"border-top-left-radius:25px;border-top-right-radius:25px;padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\">\n<p class=\"has-text-align-left has-primary-white-color has-text-color has-link-color has-medium-font-size wp-elements-6301697aa709cd5313113f335408eaf4\">&#8220;There may be more states and advocacy groups looking for opportunities now to challenge diversity programs that are not properly designed or communicated.&#8221;<\/p>\n\n\n\n<p class=\"has-primary-white-color has-text-color has-link-color wp-elements-52fb3a4b395ced52d617ec3a92e4c32d\">Matthew Camardella, co-leader of the Affirmative Action practice group at Jackson Lewis.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"not-deis-demise\">Not so fast for DEI&#8217;s demise<\/h2>\n\n\n\n<p>Despite those concerns, EEOC Chair Burrows notes that it remains lawful for employers to implement diversity, equity, inclusion and accessibility programs that seek to ensure workers of all backgrounds have equal opportunity in the workplace.<\/p>\n\n\n\n<p>That doesn&#8217;t mean, however, that employer DEI programs are immune from this ruling. It&#8217;s imperative that HR reassess policies to make sure they&#8217;re handling affirmative action issues properly, according to Stephen Paskoff, CEO of Employment Learning Innovations.<\/p>\n\n\n\n<p>&#8220;If you have disparate treatment in your workplace where people are treated differently when they perform or behave in the same or similar manner, that will continue to be an issue and needs to be looked at very, very carefully,&#8221; Paskoff added.<\/p>\n\n\n\n<p>DEI remains an enviable goal that can help create a more productive workforce.
