An employer must <a href=\"\/us\/solutions\/hr-compliance\/\">comply<\/a> with both federal and state law.<\/p>\n\n\n\n<p class=\"\">An employer must also comply with applicable municipal law obligations affecting the employment relationship, in addition to complying with state and federal requirements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"EEO-Diversity-and-Employee-Relations\">EEO, diversity and employee relations<\/h2>\n\n\n\n<p class=\"\">Key Montana requirements impacting EEO, diversity and employee relations are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fair employment practices<\/h3>\n\n\n\n<p class=\"\">The Montana Human Rights Act (MHRA) makes it unlawful for an employer to discriminate against employees on the basis of protected characteristics including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Race<\/li>\n\n\n\n<li class=\"\">Creed<\/li>\n\n\n\n<li class=\"\">Religion<\/li>\n\n\n\n<li class=\"\">Color<\/li>\n\n\n\n<li class=\"\">National origin<\/li>\n\n\n\n<li class=\"\">Age<\/li>\n\n\n\n<li class=\"\">Physical or mental disability<\/li>\n\n\n\n<li class=\"\">Marital status<\/li>\n\n\n\n<li class=\"\">Sex<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Under the MHRA, harassment is a form of illegal discrimination when based on a protected characteristic.<\/p>\n\n\n\n<p class=\"\">The MHRA also prohibits retaliation against a person for opposing illegal discrimination, filing a complaint or participating in an investigation of illegal discrimination.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Equal pay<\/h3>\n\n\n\n<p class=\"\">Montana law prohibits an employer from paying women less than men for equivalent service or for the same amount or class of work or labor in the same industry, establishment, office or place of employment.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"Whistleblower-Protections\">Whistleblower protections<\/h3>\n\n\n\n<p class=\"\">Montana&#8217;s Securities Whistleblower Award and Protection Act provides:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Protection for those who make whistleblower complaints concerning a possible violation of state or federal securities laws, including any implementing rules or regulations<\/li>\n\n\n\n<li class=\"\">Monetary awards to whistleblowers through a state-run whistleblower program<\/li>\n<\/ul>\n\n\n\n<p class=\"\">An employer may not retaliate against an individual who makes a protected disclosure, including by:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Termination<\/li>\n\n\n\n<li class=\"\">Discharge<\/li>\n\n\n\n<li class=\"\">Demotion<\/li>\n\n\n\n<li class=\"\">Suspension<\/li>\n\n\n\n<li class=\"\">Threats<\/li>\n\n\n\n<li class=\"\">Harassment, whether directly or indirect<\/li>\n\n\n\n<li class=\"\">In any other manner retaliating against an individual<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Recruiting-and-Hiring\">Recruiting and hiring<\/h2>\n\n\n\n<p class=\"\">Key Montana requirements impacting recruiting and hiring are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Credit checks<\/h3>\n\n\n\n<p class=\"\">Similar to federal law, Montana law prohibits an employer from obtaining a consumer or an investigative credit report unless a clear and conspicuous written disclosure has been made to the applicant and the employer has obtained the applicant&#8217;s written authorization. The minimum wage is adjusted for inflation every year.<\/p>\n\n\n\n<p class=\"\">An employer that has gross sales receipts of less than $110,000 per year and that is not covered by the federal Fair Labor Standards Act (FLSA) may pay a lower wage.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Overtime<\/h3>\n\n\n\n<p class=\"\">Nonexempt employees generally must receive overtime compensation at a rate of one-and-one-half times their regular hourly rate for all hours worked over 40 in a workweek. With certain exceptions, an employee who works part of the workweek in nonexempt employment and part in other employment should receive overtime pay for all hours worked in that workweek regardless of the differing employments.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Child labor<\/h3>\n\n\n\n<p class=\"\">Child labor laws in Montana restrict the occupations in which minors may be employed and the number of hours and times during which they may work.<\/p>\n\n\n\n<p class=\"\">All minors are prohibited from working in hazardous occupations, and minors under the age of 16 age are prohibited from working in a variety of other occupations such as manufacturing, warehousing and construction. Child labor laws also list many occupations in which minors are actively permitted to engage, such as newspaper delivery and office and clerical work.<\/p>\n\n\n\n<p class=\"\">Minors who are 14 or 15 years of age generally may not work:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">During school hours<\/li>\n\n\n\n<li class=\"\">Before 7:00 a.m.<\/li>\n\n\n\n<li class=\"\">After 7:00 p.m. during the school year<\/li>\n\n\n\n<li class=\"\">After 9:00 p.m. outside the school year (June 1 through Labor Day, depending on local standards)<\/li>\n\n\n\n<li class=\"\">More than three hours on a school day<\/li>\n\n\n\n<li class=\"\">More than eight hours on a nonschool day<\/li>\n\n\n\n<li class=\"\">More than 18 hours in a school week<\/li>\n\n\n\n<li class=\"\">More than 40 hours in a nonschool week<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Pay-and-Benefits\">Pay and benefits<\/h2>\n\n\n\n<p class=\"\">Key Montana requirements impacting pay and benefits are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Payment of wages<\/h3>\n\n\n\n<p class=\"\">A Montana employer must pay employees&#8217; wages in cash or by check. Wages may be paid by direct deposit or electronic paycard if certain conditions are met.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pay frequency<\/h3>\n\n\n\n<p class=\"\">An employer in Montana must pay employees on regularly scheduled paydays established in advance. If an employer fails to establish a regular pay period, a semimonthly pay period will be presumed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Wage notices<\/h3>\n\n\n\n<p class=\"\">An employer must notify employees of:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Their rate of pay<\/li>\n\n\n\n<li class=\"\">The pay period<\/li>\n\n\n\n<li class=\"\">The dates of paydays<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Such notification must be provided in writing to each employee or by posting notice in a conspicuous place.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pay statements<\/h3>\n\n\n\n<p class=\"\">An employer must provide each employees with an itemized pay statement when wages are paid. The statement must show all deductions for the pay period. A statement must be provided even if no deductions were made.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Wage deductions<\/h3>\n\n\n\n<p class=\"\">In general, an employer may make deductions from wages:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">For the reasonable cost of room, board and other incidentals supplied by the employer<\/li>\n\n\n\n<li class=\"\">As otherwise provided for by law (e.g., federal and state taxes, Social Security or garnishment order)<\/li>\n\n\n\n<li class=\"\">If authorized in writing by the employee for his or her own benefit (e.g., health or retirement plan deductions)<\/li>\n<\/ul>\n\n\n\n<p class=\"\">An employer may not make deductions for damages, mistakes or shortages.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Time-Off-and-Leaves-of-Absence\">Time off and leaves of absence<\/h2>\n\n\n\n<p class=\"\">Montana has a few laws relating to required time off and leaves of absence for employees, which cover all employers. These laws include:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Maternity leave<\/li>\n\n\n\n<li class=\"\">Crime victim leave<\/li>\n\n\n\n<li class=\"\">Military leave<\/li>\n\n\n\n<li class=\"\">Emergency responder leave<\/li>\n\n\n\n<li class=\"\">Public official leave<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Health-and-Safety\">Health and safety<\/h2>\n\n\n\n<p class=\"\">Key Montana requirements impacting health and safety are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Occupational safety and health<\/h3>\n\n\n\n<p class=\"\">Under the Montana Safety Culture Act, all employers are required to develop and administer a safety program for all employees that encompasses training. An employer with more than five employees must also create a safety committee.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Smoke-free workplace<\/h3>\n\n\n\n<p class=\"\">The Montana Clean Indoor Air Act prohibits smoking in any enclosed public place, including workplaces. <em>Smoking<\/em> includes the use of marijuana or an electronic smoking device.
