An employer must <a href=\"\/us\/solutions\/hr-compliance\/\">comply<\/a> with both federal and state law.<\/p>\n\n\n\n<p class=\"\">An employer must also comply with applicable municipal law obligations affecting the employment relationship, in addition to complying with state and federal requirements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"EEO-Diversity-and-Employee-Relations\">EEO, diversity and employee relations<\/h2>\n\n\n\n<p class=\"\">Key Nebraska requirements impacting EEO, diversity and employee relations are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fair employment practices<\/h3>\n\n\n\n<p class=\"\">The Nebraska Fair Employment Practice Act prohibits employers with 15 or more employees from discriminating against or harassing individuals on the basis of protected characteristics, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Race<\/li>\n\n\n\n<li class=\"\">Color<\/li>\n\n\n\n<li class=\"\">Sex (including pregnancy)<\/li>\n\n\n\n<li class=\"\">National origin<\/li>\n\n\n\n<li class=\"\">Marital status<\/li>\n\n\n\n<li class=\"\">Military and veteran status<\/li>\n\n\n\n<li class=\"\">Disability<\/li>\n\n\n\n<li class=\"\">Religion<\/li>\n<\/ul>\n\n\n\n<p class=\"\">The Nebraska Age Discrimination in Employment Act prohibits employers with 20 or more employees from discriminating on the basis of age (40 years and older).<\/p>\n\n\n\n<p class=\"\">Under Nebraska&#8217;s antidiscrimination laws, an employer may not retaliate against individuals who oppose discriminatory employment practices or who file a charge or testify, participate or assist in proceedings under applicable law.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Equal pay<\/h3>\n\n\n\n<p class=\"\">The Nebraska Equal Pay Act (NEPA) prohibits employers with two or more employees from discriminating between employees in the same establishment on the basis of sex by paying wages to any employee at a rate less than that paid to any employee of the opposite sex for equal work on jobs that require equal skill, effort and responsibility under similar working condition. Nothing in the NEPA prohibits employers from basing wage differentials on a seniority system, a merit system, a system that measures earnings by quantity or quality of production or any factor other than sex.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Discussion of wages<\/h3>\n\n\n\n<p class=\"\">An employer may not discriminate against an employee or applicant because the individual inquired about, discussed or disclosed information regarding employee wages, benefits or other compensation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pregnancy accommodation<\/h3>\n\n\n\n<p class=\"\">The NFEPA requires an employer with 15 or more employees to provide reasonable accommodations for pregnancy, childbirth and related medical conditions. Reasonable accommodations include, but are not limited to:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Acquisition of equipment for sitting<\/li>\n\n\n\n<li class=\"\">More frequent or longer breaks<\/li>\n\n\n\n<li class=\"\">Periodic rest<\/li>\n\n\n\n<li class=\"\">Assistance with manual labor<\/li>\n\n\n\n<li class=\"\">Job restructuring<\/li>\n\n\n\n<li class=\"\">Light-duty assignments<\/li>\n\n\n\n<li class=\"\">Modified work schedules<\/li>\n\n\n\n<li class=\"\">Temporary transfers to less-strenuous or less-hazardous work<\/li>\n\n\n\n<li class=\"\">Time off to recover from childbirth<\/li>\n\n\n\n<li class=\"\">Break time and appropriate facilities for breastfeeding or expressing breast milk<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Recruiting-and-Hiring\">Recruiting and hiring<\/h2>\n\n\n\n<p class=\"\">A Nebraska employer generally may conduct drug and alcohol testing as a condition of employment, but state law, which applies to employers with six or more employees, regulates the manner in which the tests are performed and how the results are handled.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<div class=\"wp-block-group alignfull has-secondary-light-gray-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-fcdab8bb wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30);padding-top:var(--wp--preset--spacing--40);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--40);padding-left:var(--wp--preset--spacing--30)\">\n<h2 class=\"wp-block-heading has-text-align-center has-large-font-size\">Want to make smarter, more-informed decisions?<\/h2>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-a89b3969 wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button has-custom-font-size\" style=\"font-size:clamp(14px, 0.875rem + ((1vw - 3.2px) * 0.274), 16px);font-style:normal;font-weight:500\"><a class=\"wp-block-button__link has-secondary-blue-color has-primary-white-background-color has-text-color has-background has-link-color wp-element-button\" href=\"\/us\/products\/hr-compliance-center\/\" style=\"border-radius:100px\">Learn more<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Wage-and-Hour\">Wage and hour<\/h2>\n\n\n\n<p class=\"\">Key Nebraska requirements impacting wages and hours are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"minimum-wage\">Minimum wage<\/h3>\n\n\n\n<p class=\"\">Nebraska employers must pay employees a minimum wage of $15.00 per hour, with exceptions for certain workers such as trainees, student-learners, youths and tipped employees. Every January 1, the minimum wage will be increased by 1.75%. Nebraska&#8217;s minimum wage requirements apply to employers employing four or more employees at any one time.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Meal breaks<\/h3>\n\n\n\n<p class=\"\">Employers that own or operate assembly plants, workshops or mechanical establishments must provide employees with a meal break of at least 30 consecutive minutes in each eight-hour shift. Employees must be relieved of all duties and may not be required to remain in the building or on the premises where their labor is performed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Child labor<\/h3>\n\n\n\n<p class=\"\">Child labor laws in Nebraska restrict the occupations in which minors may be employed and the number of hours and times during which they may work.<\/p>\n\n\n\n<p class=\"\">All minors are generally prohibited from working in a job that is dangerous or where &#8220;his or her morals may be depraved.&#8221;<\/p>\n\n\n\n<p class=\"\">Minors under the age of 16 may not work:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">More than eight hours in one day<\/li>\n\n\n\n<li class=\"\">More than 48 hours in one week<\/li>\n\n\n\n<li class=\"\">Before 6 a.m. or after 8 p.m. if they are under the age of 14, or after 10 p.m. if they are between 14 and 16 years old<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Pay-and-Benefits\">Pay and benefits<\/h2>\n\n\n\n<p class=\"\">Key Nebraska requirements impacting pay and benefits are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Health care continuation<\/h3>\n\n\n\n<p class=\"\">Nebraska employers with fewer than 20 employees generally must offer health care continuation coverage to their employees and their dependents. Continuation coverage is available only when the employee dies or is involuntarily terminated (unless for misconduct) and only for up to six months.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pay frequency<\/h3>\n\n\n\n<p class=\"\">A Nebraska employer must pay all wages due on regular days that are:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Designated by the employer; or<\/li>\n\n\n\n<li class=\"\">Agreed upon by the employer and employee.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">An employer must provide employees with 30 days&#8217; written notice before changing paydays.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pay statements<\/h3>\n\n\n\n<p class=\"\">An employer must provide a pay statement to each employee on payday that includes the following information:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Employer&#8217;s identity<\/li>\n\n\n\n<li class=\"\">Hours for which the employee is being paid<\/li>\n\n\n\n<li class=\"\">Amount of wages earned by the employee for the pay period<\/li>\n\n\n\n<li class=\"\">Deductions taken from the employee&#8217;s pay<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Wage deductions<\/h3>\n\n\n\n<p class=\"\">An employer may make deductions from employees&#8217; wages that are:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Required by state or federal law<\/li>\n\n\n\n<li class=\"\">Expressly authorized in writing by the employee (e.g., for health insurance, retirement, breakages, uniforms or cash shortages)<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Time-Off-and-Leaves-of-Absence\">Time off and leaves of absence<\/h2>\n\n\n\n<p class=\"\">Key Nebraska requirements impacting time off and leaves of absence are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Paid sick leave<\/h3>\n\n\n\n<p class=\"\">Employers with 11 or more employees must provide paid sick time to eligible employees for absences related to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">The employee&#8217;s or a family member&#8217;s mental or physical illness, injury or health condition; need for medical diagnosis, care or treatment; or need for preventive medical care;<\/li>\n\n\n\n<li class=\"\">Attendance at a meeting necessitated by a child&#8217;s mental or physical illness, injury or health condition at a school or place of care;<\/li>\n\n\n\n<li class=\"\">Closure of the employee&#8217;s place of business or a child&#8217;s school or place of care due to a public health emergency; and<\/li>\n\n\n\n<li class=\"\">The employee&#8217;s or a family member&#8217;s exposure to a communicable disease.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Other Time Off Requirements Affecting Nebraska Employers <\/h3>\n\n\n\n<p class=\"\">In addition to the paid sick leave law, a Nebraska employer is also required to comply with other leave and time off laws, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Family military leave (covering employers with 15 or more employees)<\/li>\n\n\n\n<li class=\"\">Military leave<\/li>\n\n\n\n<li class=\"\">Voting leave<\/li>\n\n\n\n<li class=\"\">Election official leave<\/li>\n\n\n\n<li class=\"\">Jury duty leave<\/li>\n\n\n\n<li class=\"\">Emergency responder leave (covering employers with 10 or more employees)<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"Health-and-Safety\">Health and safety<\/h2>\n\n\n\n<p class=\"\">Key Nebraska requirements impacting health and safety are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Smoke-free workplace<\/h3>\n\n\n\n<p class=\"\">The Nebraska Clean Indoor Air Act prohibits smoking in a place of employment or a public place, but does not prohibit or restrict smoking in outdoor areas.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Weapons in the workplace<\/h3>\n\n\n\n<p class=\"\">Employers in control of property may prohibit a permitholder from carrying a concealed handgun into or onto the place or premises if the place or premises are open to the public, and if the employer has posted conspicuous notice that carrying a concealed handgun is prohibited in or on the place or premises or has requested that a permitholder remove the concealed handgun from the place or premises.<\/p>\n\n\n\n<p class=\"\">An employer may also prohibit employees or other permitholders from carrying concealed handguns in employer-owned vehicles.
