An employer must <a href=\"\/us\/solutions\/hr-compliance\/\">comply<\/a> with both federal and state law.<\/p>\n\n\n\n<p class=\"\">An employer must also comply with applicable municipal law obligations affecting the employment relationship in addition to complying with state and federal requirements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"eeo-diversity-employee-relations\">EEO, diversity and employee relations<\/h2>\n\n\n\n<p class=\"\">Key Hawaii requirements impacting EEO, diversity and employee relations are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"fair-employment-practices-hi\">Fair employment practices<\/h3>\n\n\n\n<p class=\"\">The Hawaii Fair Employment Practices Act applies to all employers and prohibits discrimination based on a number of protected characteristics, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Race<\/li>\n\n\n\n<li class=\"\">Color<\/li>\n\n\n\n<li class=\"\">National origin<\/li>\n\n\n\n<li class=\"\">Ancestry<\/li>\n\n\n\n<li class=\"\">Religion<\/li>\n\n\n\n<li class=\"\">Sex (including gender identity and expression)<\/li>\n\n\n\n<li class=\"\">Pregnancy (including childbirth, breastfeeding and related medical conditions)<\/li>\n\n\n\n<li class=\"\">Disability (mental and physical) and genetic information<\/li>\n\n\n\n<li class=\"\">Age<\/li>\n\n\n\n<li class=\"\">Sexual orientation<\/li>\n\n\n\n<li class=\"\">Status as a domestic or sexual violence victim<\/li>\n\n\n\n<li class=\"\">Arrest and court record<\/li>\n\n\n\n<li class=\"\">Marital status<\/li>\n\n\n\n<li class=\"\">Reproductive health decisions<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Harassment is a form of illegal discrimination.<\/p>\n\n\n\n<p class=\"\">The law also prohibits retaliation against a person who:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Files a complaint of discrimination or harassment; or<\/li>\n\n\n\n<li class=\"\">Participates in an EEO investigation.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Whistleblower protections<\/h3>\n\n\n\n<p class=\"\">Under the Whistleblowers&#8217; Protection Act, an employer may not terminate or otherwise discriminate against an employee who reports, or is about to report, violations or suspected violations of the law to the employer or to a government agency.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"equal-pay-hi\">Equal pay<\/h3>\n\n\n\n<p class=\"\">The Hawaii Fair Employment Practices Act includes an equal pay provision that prohibits pay discrimination on the basis of any protected characteristic. Specifically, Hawaii employers are prohibited from discriminating against employees in the same establishment on the basis of a protected characteristic by paying wages at a rate less than the rate at which the employer pays wages to employees with different protected characteristics for substantially similar work on jobs requiring equal skill, effort, and responsibility and performed under similar working conditions. Wage differentials are permissible if based on:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">A seniority system<\/li>\n\n\n\n<li class=\"\">A merit system<\/li>\n\n\n\n<li class=\"\">A system measuring earnings by quantity or quality of production<\/li>\n\n\n\n<li class=\"\">A bona fide occupational qualification<\/li>\n\n\n\n<li class=\"\">A differential based on any other permissible factor other than a protected characteristic<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Similarly, Hawaii&#8217;s wage and hour law bans discrimination in the payment of wages based on race, religion, or sex. The law does not prohibit varying wage rates for employees engaged in the same classification of work based upon differences in in seniority, length of service, substantial differences in duties or services performed, or differences in shift or time of day worked or hours of work.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"discussion-of-wages-hi\">Discussion of wages<\/h3>\n\n\n\n<p class=\"\">Hawaii employers are prohibited from discriminating or retaliating against an employee for disclosing the employee&#8217;s wages, discussing and inquiring about the wages of other employees, or aiding or encouraging other employees to exercise their rights under this law. Hawaii employers also may not prohibit an employee from, disclosing the employee&#8217;s wages, discussing and inquiring about the wages of other employees, or aiding or encouraging other employees to exercise their rights under this law.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"recruiting-hiring\">Recruiting and hiring<\/h2>\n\n\n\n<p class=\"\">Key Hawaii requirements impacting recruiting and hiring are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"credit-checks-hi\">Credit Checks<\/h3>\n\n\n\n<p class=\"\">In Hawaii, credit checks may only be performed for certain types of jobs and can only be done post-offer. An employer may consider an applicant&#8217;s credit history under certain circumstances, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">The information directly relates to a bona fide occupational qualification;<\/li>\n\n\n\n<li class=\"\">Federal or state law expressly permits or requires an employer to take the information into consideration for employment purposes; or<\/li>\n\n\n\n<li class=\"\">The employer is a federally insured financial institution.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Criminal Checks<\/h3>\n\n\n\n<p class=\"\">Hawaii prohibits employers from making any employment decisions based on an employee&#8217;s arrest and court record. Convictions may be taken into consideration, post-offer, but only if the conviction:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Occurred within the last 10 years, excluding periods of incarceration; and<\/li>\n\n\n\n<li class=\"\">Bears a rational relationship to the duties and responsibilities of the position in question.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Drug Testing<\/h3>\n\n\n\n<p class=\"\">Employers that are not subject to federal regulations must comply with Hawaii&#8217;s substance abuse testing law. This law requires employers to:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Use only licensed laboratories for testing<\/li>\n\n\n\n<li class=\"\">Pay for all testing costs<\/li>\n\n\n\n<li class=\"\">Provide individuals to be tested with a written statement of the specific substances to be tested for, among other information<\/li>\n\n\n\n<li class=\"\">Keep any information concerning a substance abuse test strictly confidential<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Ban the box<\/h3>\n\n\n\n<p class=\"\">Hawaii prohibits an employer from inquiring about arrest or conviction records in employment applications.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"salary-history-inquiry-restrictions-hi\">Salary history inquiry restrictions<\/h3>\n\n\n\n<p class=\"\">Hawaii has a salary history inquiry ban and generally prohibits employers from:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Inquiring about the salary history of an applicant for employment<\/li>\n\n\n\n<li class=\"\">Relying on the salary history of an applicant in determining the salary, benefits, or other compensation for the applicant during the hiring process, including the negotiation of an employment contract<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Without inquiring about salary history, an employer may engage in discussions with an applicant for employment about the applicant&#8217;s expectations with respect to salary, benefits, and other compensation.<\/p>\n\n\n\n<p class=\"\">If an applicant voluntarily and without prompting discloses salary history to an employer, the employer may consider salary history in determining salary, benefits, and other compensation for the applicant, and may verify the applicant&#8217;s salary history.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"pay-transparency\">Pay transparency<\/h3>\n\n\n\n<p class=\"\">Hawaii employers with 50 or more employees must include an hourly rate or salary range in job listings. Currently, the state minimum wage is $16.00 per hour, with certain exceptions.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"overtime-hi\">Overtime<\/h3>\n\n\n\n<p class=\"\">Hawaii law generally requires an employer to pay covered employees overtime at a rate of one and one-half times the regular rate for all hours worked in excess of 40 hours in a workweek.<\/p>\n\n\n\n<p class=\"\">Hawaii uses different formulas for determining an employee&#8217;s regular rate, which take into consideration: the frequency of the payment (weekly, biweekly, semi-monthly or monthly); whether the cost of room, board and other furnishings is included in the employee&#8217;s pay; and whether the employee is employed in the agriculture industry.<\/p>\n\n\n\n<p class=\"\">The formula for calculating overtime pay differs depending on whether the employee earns less than $2,000 per month or at least $2,000 per month.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"breastfeeding-breaks-hi\">Breastfeeding breaks<\/h3>\n\n\n\n<p class=\"\">Under Hawaii law, an employer must provide employees reasonable break time each time they need to express breast milk for a nursing child for up to one year after the child&#8217;s birth. An employer must also provide a private space (other than a restroom stall) and inform employees about the law&#8217;s protections.<\/p>\n\n\n\n<p class=\"\">An employer with fewer than 20 employees may be excused from these requirements if it can show that the law would impose an undue hardship.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"child-labor-hi\">Child labor<\/h3>\n\n\n\n<p class=\"\">Child labor laws in Hawaii restrict the occupations in which minors may be employed and the number of hours and times during which they may work.<\/p>\n\n\n\n<p class=\"\">Under Hawaii law, all minors are prohibited from working in hazardous occupations or in any occupation connected with adult entertainment. In addition, minors who are under 16 years of age are prohibited from working in a variety of other occupations, such as manufacturing or processing operations, and certain agricultural, retail and food service occupations.<\/p>\n\n\n\n<p class=\"\">Child labor laws also list many occupations in which minors are actively permitted to engage, such as cashiering, selling, modeling, and office and clerical work. Special rules apply to minors working in certain occupations, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Theatrical employment<\/li>\n\n\n\n<li class=\"\">Coffee harvesting<\/li>\n\n\n\n<li class=\"\">Pineapple harvesting<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Hawaii law has a complex set of requirements that govern the times during which minors may work. These requirements differ depending on the age of the minor, with separate working time restrictions set out for 16- and 17-year-olds, for 14- and 15-year-olds and for minors under 14 years of age.<\/p>\n\n\n\n<p class=\"\">Hawaii law requires an employer to provide at least a 30-minute meal or rest break to all 14- or 15-year-old minors who work five consecutive hours.<\/p>\n\n\n\n<p class=\"\">Minors are required to obtain a certificate of employment or age in order to work.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"pay-benefits\">Pay and benefits<\/h2>\n\n\n\n<p class=\"\">Key Hawaii requirements impacting pay and benefits are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"temporary-disability-insurance-hi\">Temporary disability insurance<\/h3>\n\n\n\n<p class=\"\">The Hawaii Temporary Disability Insurance (TDI) Law provides up to 26 weeks of partial wage replacement for eligible employees who are unable to work due to a nonwork-related injury or illness, including pregnancy and organ donation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"health-care-continuation-hi\">Health care continuation<\/h3>\n\n\n\n<p class=\"\">If an employee is hospitalized or cannot work because of sickness, the employer must continue the employee&#8217;s health care coverage and pay the employee&#8217;s premiums for three months following the month in which the disability began, or for as long as the employee receives regular wages, whichever is longer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"payment-of-wages-hi\">Payment of wages<\/h3>\n\n\n\n<p class=\"\">An employer must pay employees either in cash or by checks that may be cashed on demand at full face value. Wages may be paid by direct deposit or payroll debit cards under certain circumstances.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"pay-statements-hi\">Pay statements<\/h3>\n\n\n\n<p class=\"\">Each payday, an employer in Hawaii is required to provide employees with a written record of certain pay-related information, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Total hours worked<\/li>\n\n\n\n<li class=\"\">Pay rate(s) and basis of pay<\/li>\n\n\n\n<li class=\"\">Total gross compensation<\/li>\n\n\n\n<li class=\"\">Any other compensation paid to the employee<\/li>\n\n\n\n<li class=\"\">Itemized deductions<\/li>\n\n\n\n<li class=\"\">Net earnings<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Pay frequency<\/h3>\n\n\n\n<p class=\"\">Hawaii law requires an employer to pay all employee wages at least semimonthly on paydays designated in advance. Monthly paydays are allowed under certain circumstances. Paydays must occur no more than seven days after the end of each payroll period. However, an employer may pay up to 15 days after the end of each payroll period with permission from the state.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"wage-deductions-hi\">Wage deductions<\/h3>\n\n\n\n<p class=\"\">Hawaii law prohibits an employer from making any deductions from an employee&#8217;s pay unless the deduction is:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Required by law or court order;<\/li>\n\n\n\n<li class=\"\">For union dues or uniforms; or<\/li>\n\n\n\n<li class=\"\">Authorized in writing by the employee.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Regardless of employee consent, an employer may not make deductions for certain fines, losses and cash shortages.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"time-off-leaves-absence\">Time off and leaves of absence<\/h2>\n\n\n\n<p class=\"\">Key Hawaii requirements impacting time off and leaves of absence are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"family-and-medical-leave-hi\">Family and medical leave<\/h3>\n\n\n\n<p class=\"\">The Hawaii Family Leave Law (HFLL) requires employers with 100 or more employees to provide eligible employees with up to four weeks of job-protected leave calendar year for qualifying reasons, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">The birth or adoption of a child<\/li>\n\n\n\n<li class=\"\">To care for a covered family member with a serious health condition<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Other time off requirements affecting Hawaii employers<\/h3>\n\n\n\n<p class=\"\">In addition to the HFLL, a Hawaii employer is also required to comply with other leave and time off laws, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Pregnancy disability leave<\/li>\n\n\n\n<li class=\"\">Organ, bone marrow and stem cell donation leave (covering employers with 50 or more employees)<\/li>\n\n\n\n<li class=\"\">Domestic and sexual violence leave<\/li>\n\n\n\n<li class=\"\">Jury duty leave<\/li>\n\n\n\n<li class=\"\">Witness leave<\/li>\n\n\n\n<li class=\"\">Military leave<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"health-safety\">Health and safety<\/h2>\n\n\n\n<p class=\"\">Key Hawaii requirements impacting health and safety are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"smoke-free-workplace-hi\">Smoke-free workplace<\/h3>\n\n\n\n<p class=\"\">Smoking (including e-cigarettes) is prohibited in all enclosed places of employment, and within 20 feet from entrances, exits, windows that open and ventilation intakes. Signs stating &#8220;Smoking Prohibited by Law&#8221; or displaying the international &#8220;No Smoking&#8221; symbol must be posted at every entrance.<\/p>\n\n\n\n<p class=\"\">Weapons in the workplace<\/p>\n\n\n\n<p class=\"\">Hawaii extensively restricts where a person may carry a firearm. In addition to banning firearms in certain locations, the state prohibits a person licensed to carry a firearm from entering or remaining on the&nbsp;private property of another person&nbsp;while carrying a firearm, unless the person has been given express authorization to carry a firearm on the property by the owner, lessee, operator or manager of the property.&nbsp;This includes employer-controlled property.<\/p>\n\n\n\n<p class=\"\">An individual may store or otherwise leave a firearm inside a vehicle, but only if the person securely locks the firearm in a safe storage depository that is out of sight from outside the vehicle.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"safe-driving-practices-hi\">Safe driving practices<\/h3>\n\n\n\n<p class=\"\">Hawaii prohibits texting while driving.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"organizational-exit\">Organizational exit<\/h2>\n\n\n\n<p class=\"\">Key Hawaii requirements impacting organizational exit are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"final-pay-hi\">Final pay<\/h3>\n\n\n\n<p class=\"\">An employee who is terminated generally must be paid all wages earned at the time of termination.<\/p>\n\n\n\n<p class=\"\">An employee who voluntarily resigns, is laid off or is suspended as a result of a labor dispute generally must be paid by the next regular pay day.
