An employer must <a href=\"https:\/\/www.brightmine.com\/us\/solutions\/reduce-compliance-risk\/\">comply<\/a> with both federal and state law.<\/p>\n\n\n\n<p class=\"\">An employer must also comply with applicable municipal law obligations affecting the employment relationship, in addition to complying with state and federal requirements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"eeo-diversity-employee-relations\">EEO, diversity and employee relations<\/h2>\n\n\n\n<p class=\"\">Key Wyoming requirements impacting EEO, diversity and employee relations are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"fair-employment-practices-wy\">Fair employment practices<\/h3>\n\n\n\n<p class=\"\">The Wyoming Fair Employment Practices Act (WFEPA) prohibits an employer with two or more employees from discriminating on the basis of protected characteristics, including:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Age (40 and over)<\/li>\n\n\n\n<li class=\"\">Sex<\/li>\n\n\n\n<li class=\"\">Race<\/li>\n\n\n\n<li class=\"\">Creed<\/li>\n\n\n\n<li class=\"\">Color<\/li>\n\n\n\n<li class=\"\">National origin<\/li>\n\n\n\n<li class=\"\">Ancestry<\/li>\n\n\n\n<li class=\"\">Pregnancy<\/li>\n\n\n\n<li class=\"\">Disability<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Equal pay<\/h3>\n\n\n\n<p class=\"\">The Wyoming Equal Pay Act requires all employers to provide equal pay to men and women for equal work. An employer is prohibited from discriminating between employees in the same establishment on the basis of gender by paying wages to employees at a rate less than the rate paid to employees of the opposite gender for equal work on jobs that require equal skill, effort and responsibility and that are performed under similar working conditions. Exceptions are allowed for pay based on:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">A seniority or merit system<\/li>\n\n\n\n<li class=\"\">A system that measures earning by quantity or quality of production<\/li>\n\n\n\n<li class=\"\">A differential based on any factor other than gender<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"wage-hour\">Wage and hour<\/h2>\n\n\n\n<p class=\"\">Key Wyoming requirements impacting wages and hours are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"minimum-wage-wy\">Minimum wage<\/h3>\n\n\n\n<p class=\"\">The minimum wage in Wyoming is $5.15 per hour. Employers that are subject to the federal Fair Labor Standards Act must pay the federal minimum wage of $7.25 per hour.<\/p>\n\n\n\n<p class=\"\">Employees under 20 years of age may be paid $4.25 for the first 90 consecutive days of work.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"child-labor-wy\">Child labor<\/h3>\n\n\n\n<p class=\"\">Child labor laws in Wyoming restrict the occupations in which minors may be employed and the number of hours and times during which they may work.<\/p>\n\n\n\n<p class=\"\">Minors under the age of 16 are prohibited from working in hazardous, such as operating heavy construction equipment, and from employment considered injurious to the morals, health or safety of a child.<\/p>\n\n\n\n<p class=\"\">Minors under the age of 16 who are enrolled in school may work:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Up to eight hours in a 12-hour period<\/li>\n\n\n\n<li class=\"\">Only between 5:00 a.m. and 10:00 p.m. on a day preceding a school day<\/li>\n\n\n\n<li class=\"\">Until midnight on a day not preceding a school day<\/li>\n\n\n\n<li class=\"\">Only during the hours when school is not in session<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Minors between the ages of 14 and 16 who are not enrolled in school may work for a maximum of eight hours between 5:00 a.m. and 12:00 a.m.<\/p>\n\n\n\n<p class=\"\">Minors under the age of 14 may not be employed except for farm, domestic or yard work or nonhazardous employment at a business owned by their parents, grandparents or legal guardians, as long as it is not during school hours.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<div class=\"wp-block-group alignfull has-secondary-light-gray-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-fcdab8bb wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30);padding-top:var(--wp--preset--spacing--40);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--40);padding-left:var(--wp--preset--spacing--30)\">\n<h2 class=\"wp-block-heading has-text-align-center has-large-font-size\">Want to make smarter, more-informed decisions?<\/h2>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-a89b3969 wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button has-custom-font-size\" style=\"font-size:clamp(14px, 0.875rem + ((1vw - 3.2px) * 0.274), 16px);font-style:normal;font-weight:500\"><a class=\"wp-block-button__link has-secondary-blue-color has-primary-white-background-color has-text-color has-background has-link-color wp-element-button\" href=\"\/us\/products\/hr-compliance-center\/\" style=\"border-radius:100px\">Learn more<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"pay-benefits\">Pay and benefits<\/h2>\n\n\n\n<p class=\"\">Key Wyoming requirements impacting pay and benefits are:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"pay-statements-wy\">Pay statements<\/h3>\n\n\n\n<p class=\"\">An employer must provide a detachable statement with paychecks, drafts or vouchers indicating any pay deductions that were made. If cash payments are made, an itemized statement of deductions must also be provided.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"pay-frequency-wy\">Pay frequency<\/h3>\n\n\n\n<p class=\"\">Wyoming employers are permitted to pay employees monthly or as otherwise agreed by the parties. However, certain employers (e.g., railroad, mine, refinery) must pay employees on the first and 15th day of the month.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"wage-deductions-wy\">Wage deductions<\/h3>\n\n\n\n<p class=\"\">An employer may make deductions from employees&#8217; wages under different circumstances, such as when required by law to do so (e.g., federal and state taxes, Social Security or a garnishment order), for cash shortages or property damage, and for union dues. However, the deductions must meet specified criteria (e.g., the employee provides written authorization for the deduction).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"health-care-continuation-wy\">Health care continuation<\/h3>\n\n\n\n<p class=\"\">Wyoming&#8217;s health care continuation coverage law generally applies to all employers not covered by the federal Consolidated Omnibus Budget Reconciliation Act. Under Wyoming law, eligible employees and covered dependents may elect to continue their health care benefits for up to 12 months after health coverage ends due to termination of employment, membership or eligibility for coverage.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"time-off-leaves-absence\">Time off and leaves of absence<\/h2>\n\n\n\n<p class=\"\">Wyoming has few laws relating to required time off and leaves of absence for employees, which cover all employers. These laws include:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Jury duty leave<\/li>\n\n\n\n<li class=\"\">Crime victim\/witness leave<\/li>\n\n\n\n<li class=\"\">Voting leave<\/li>\n\n\n\n<li class=\"\">Military leave<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"health-safety\">Health and safety<\/h2>\n\n\n\n<p class=\"\">Key Wyoming requirements impacting health and safety are:<\/p>\n\n\n\n<p class=\"\">Weapons in the workplace<\/p>\n\n\n\n<p class=\"\">Wyoming law does not prohibit employees with proper licenses from storing their firearms in their vehicles while at work, even if the vehicle is on the employer&#8217;s property. However, Wyoming allows private property owners to restrict firearms on their private property.<\/p>\n\n\n\n<p class=\"\">Safe driving practices<\/p>\n\n\n\n<p class=\"\">Wyoming prohibits drivers from using a handheld electronic wireless communication device to write, send or read a text-based communication while operating a motor vehicle on a public street or highway. Using voice-operated or hands-free technology is allowed.<\/p>\n\n\n\n<p class=\"\">Be aware that where there is overlap between federal, state and\/or local law, complying with the law that offers the greatest rights or benefits to the employee will generally apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"organizational-exit\">Organizational exit<\/h2>\n\n\n\n<p class=\"\">An employee who quits or is terminated must be paid in cash, by check or by draft that can be cashed at a bank.
