href=\"https:\/\/www.brightmine.com\/us\/solutions\/efficiencies-automation\/\">artificial intelligence (AI)<\/a> does not result in discrimination and to disclose their use of AI in employment decisions.<\/p>\n\n\n\n<p class=\"\">Effective January 1, 2026, <a href=\"https:\/\/www.ilga.gov\/legislation\/publicacts\/fulltext.asp?Name=103-0804\" target=\"_blank\" rel=\"noreferrer noopener\">Public Act 103-0804<\/a> will make it a violation of the <a href=\"https:\/\/www.brightmine.com\/us\/resources\/guides-how-to\/illinois-employment-law\/#fair-employment-practices-il\">Illinois Human Rights Act (IHRA)<\/a> for employers to:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Use artificial intelligence in recruitment, hiring, promotion and other employment decisions in a way that subjects employees to discrimination.<\/li>\n\n\n\n<li class=\"\">Use ZIP codes as a proxy for the IHRA&#8217;s protected classes, such as race, religion or sex.<\/li>\n\n\n\n<li class=\"\">Fail to notify an employee that they are using AI for employment decisions.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">The penalties for violating the IHRA include back pay, attorney fees and actual damages for injury or loss.<\/p>\n\n\n\n<p class=\"\">&#8220;Companies that are using AI to make employment decisions may be using data points that are discriminatory and having adverse effects on our communities,&#8221; said one of the law&#8217;s sponsors, State Senator Javier Cervantes. &#8220;Creating a model to predict data patterns is fine, but when it&#8217;s used to single out and target workers from lower-income communities, Black and Brown communities, and many of the other underserved communities in Illinois, we cannot sit back and allow it to happen.&#8221;<\/p>\n\n\n\n<p class=\"\">The law defines AI broadly as a machine-based system that generates outputs such as predictions, content, recommendations or decisions. It also includes <a href=\"https:\/\/www.brightmine.com\/us\/resources\/blogs\/generative-ai-in-hr\/\">generative AI<\/a> that can produce prose, images, audio, video and more.<\/p>\n\n\n\n<p class=\"\">Although the law does not explicitly reference job applicants, they may be covered under the umbrella of recruitment.<\/p>\n\n\n\n<p class=\"\">The law directs the Illinois Department of Human Rights to adopt regulations &#8220;necessary for the implementation and enforcement&#8221; of the new law, including rules on the circumstances and conditions that require notice, the time period for providing notice, and the means for providing notice.<\/p>\n\n\n\n<p class=\"\">Illinois becomes the second state, following <a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-news\/colorado-ai-law-regulates-ai-in-employment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Colorado<\/a>, to enact a broad law regulating the use of <a href=\"https:\/\/www.brightmine.com\/us\/resources\/blogs\/ai-and-human-resources\/\">AI in employment<\/a>.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column lnrs-hide-block-on-mobile is-layout-flow wp-block-column-is-layout-flow\" style=\"border-left-color:var(--wp--preset--color--secondary-gray);border-left-width:2px;padding-left:10px;flex-basis:30%\">\n<div
