{"id":7044,"date":"2024-10-16T17:03:11","date_gmt":"2024-10-16T17:03:11","guid":{"rendered":"https:\/\/www.brightmine.com\/us\/?post_type=resources&#038;p=7044"},"modified":"2026-02-05T04:10:39","modified_gmt":"2026-02-05T09:10:39","slug":"minimum-wage-changes-2024-ballot","status":"publish","type":"resources","link":"https:\/\/www.brightmine.com\/us\/resources\/hr-compliance\/wage-hour\/minimum-wage\/minimum-wage-changes-2024-ballot\/","title":{"rendered":"Minimum wage changes will be on the ballot in multiple states"},"content":{"rendered":"\n<div class=\"wp-block-group alignwide has-primary-white-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-b5fc8583 wp-block-group-is-layout-constrained\" style=\"border-radius:25px;padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-7fc3d43a wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:70%\">\n<div class=\"wp-block-group is-vertical is-layout-flex wp-container-core-group-is-layout-8e1436f2 wp-block-group-is-layout-flex\" style=\"margin-top:0;margin-bottom:0\">\n<p class=\"\">by <strong>Michael Cardman<\/strong>, Senior Legal Editor at Brightmine<\/p>\n<\/div>\n\n\n\n<p class=\"\">On Election Day, November 5, voters will decide the fate of minimum wage initiatives in <a href=\"#alaska\">Alaska<\/a>, <a href=\"#arizona\">Arizona<\/a>, <a href=\"#california\">California<\/a>, <a href=\"#massachusetts\">Massachusetts<\/a>, <a href=\"#missouri\">Missouri<\/a> and <a href=\"#everett-washington\">Everett, Washington<\/a>.<\/p>\n\n\n\n<p class=\"\">Minimum wage increases have proven quite popular with voters in recent years. Of the <a href=\"https:\/\/ballotpedia.org\/Minimum_wage_on_the_ballot#Outcomes_of_minimum_wage_measures.2C_1996-2023\" target=\"_blank\" rel=\"noreferrer noopener\">28 measures that have appeared on the ballot since 1996<\/a>, all but two have been approved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"alaska\">Alaska<\/h2>\n\n\n\n<p class=\"\">In Alaska, <a href=\"https:\/\/www.elections.alaska.gov\/petitions\/23AMLS\/23AMLS-Bill.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Ballot Measure 1<\/a> would increase the state minimum wage to:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">$13.00 per hour, effective July 1, 2025.<\/li>\n\n\n\n<li class=\"\">$14.00 per hour, effective July 1, 2026.<\/li>\n\n\n\n<li class=\"\">$15.00 per hour, effective July 1, 2027.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">After that, the minimum wage would be adjusted for inflation every year.<\/p>\n\n\n\n<p class=\"\">Ballot Measure 1 also would require employers to provide employees with paid sick leave \u2014 40 hours for small employers with 15 or fewer employees and 56 hours for large employers with 15 or more employees.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"arizona\">Arizona<\/h2>\n\n\n\n<p class=\"\">In Arizona, <a href=\"https:\/\/azsos.gov\/sites\/default\/files\/docs\/2024_0821_Final_2024_Ballot_Language_English.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Proposition 138<\/a> (as added by <a href=\"https:\/\/www.azleg.gov\/legtext\/56leg\/2R\/bills\/SCR1040H.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Concurrent Resolution 1040<\/a>) would allow employers to pay employees up to 25% less than the minimum hourly wage if the employer can establish that the employee&#8217;s wage plus tips or gratuities is at least $2.00 more than the minimum wage for every hour worked. To determine employees&#8217; eligibility for this lower minimum wage, tips or gratuities would be averaged over the employer&#8217;s payroll period or any other period selected by the employer that complies with state laws.<\/p>\n\n\n\n<p class=\"\">Currently, <a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/minimum-wage-arizona\/318\/#tip-credit-az\" target=\"_blank\" rel=\"noreferrer noopener\">employers in Arizona may claim a tip credit<\/a> of no more than $3.00 per hour. As a result, the minimum direct cash wage for tipped employees is currently $11.35 per hour (the 2024 minimum wage of $14.35 minus $3.00). Effective January 1, 2025, the minimum direct cash wage for tipped employees will increase to $11.70 per hour (the 2025 minimum wage of $14.70 minus $3.00).<\/p>\n\n\n\n<p class=\"\">If Proposition 138 is enacted, the minimum direct cash wage in 2025 would be $11.03 per hour for tipped employees whose weekly wages plus tips or gratuities are at least $16.70 per hour worked.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"california\">California<\/h2>\n\n\n\n<p class=\"\">In California, Proposition 32 (also known as the Living Wage Act of 2022) would increase the state minimum wage to:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">$17.00 per hour for large employers with 26 or more employees and $16.00 per hour for small employers with 25 or fewer employees, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=CONS&amp;division=&amp;title=&amp;part=&amp;chapter=&amp;article=II\" target=\"_blank\" rel=\"noreferrer noopener\">projected<\/a> effective December 18, 2024 (or five days after the Secretary of State certifies the election results).<\/li>\n\n\n\n<li class=\"\">$18.00 per hour for large employers with 26 or more employees and $17.00 per hour for small employers with 25 or fewer employees, effective January 1, 2025.<\/li>\n\n\n\n<li class=\"\">$18.00 per hour for small employers with 25 or fewer employees, effective January 1, 2026 (the minimum wage would remain $18.00 for large employers).<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Starting January 1, 2027, and every January 1 thereafter, the minimum wage would be adjusted for inflation.<\/p>\n\n\n\n<p class=\"\">If enacted, Proposition 32 would have downstream effects on other pay requirements, as well. Among other things, it would:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Raise the minimum salaries for overtime-exempt <a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/employee-classification-california\/285\/#the-salary-basis-test-ca\" target=\"_blank\" rel=\"noreferrer noopener\">executive, administrative and professional employees<\/a> and <a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/employee-classification-california\/285\/#inside-salespersons-ca\" target=\"_blank\" rel=\"noreferrer noopener\">inside salespersons<\/a>.<\/li>\n\n\n\n<li class=\"\">Render moot the local minimum wage requirements in <a href=\"https:\/\/hrcenter.us.brightmine.com\/fifty-state-charts\/minimum-wage-rates-by-state-and-municipality\/7038\/\" target=\"_blank\" rel=\"noreferrer noopener\">many cities and counties throughout California<\/a> for large employers (and, to a lesser extent, small employers).<\/li>\n\n\n\n<li class=\"\">Raise the <a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/minimum-wage-california\/320\/#subminimum-wages-ca\" target=\"_blank\" rel=\"noreferrer noopener\">subminimum wage for learners<\/a> and the maximum <a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/minimum-wage-california\/320\/#deductions-below-the-ca\" target=\"_blank\" rel=\"noreferrer noopener\">deduction for meals and lodging<\/a>.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">According to one recent poll, support for Proposition 32 is decreasing as Election Day approaches; however, it maintains a plurality of support.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"massachusetts\">Massachusetts<\/h2>\n\n\n\n<p class=\"\">In Massachusetts, <a href=\"https:\/\/www.mass.gov\/doc\/23-12-initiative-petition-for-a-law-requiring-the-full-minimum-wage-for-tipped-workers-with-tips-on-top\/download\" target=\"_blank\" rel=\"noreferrer noopener\">Question 5<\/a> would gradually phase out the state&#8217;s minimum wage tip credit by raising the minimum direct cash wage for tipped employees from $6.75 per hour to:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">64% of the minimum wage, effective January 1, 2025.<\/li>\n\n\n\n<li class=\"\">73% of the minimum wage, effective January 1, 2026.<\/li>\n\n\n\n<li class=\"\">82% of the minimum wage, effective January 1, 2027.<\/li>\n\n\n\n<li class=\"\">91% of the minimum wage, effective January 1, 2028.<\/li>\n\n\n\n<li class=\"\">100% of the minimum wage, effective January 1, 2029 (effectively eliminating the tip credit).<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Effective January 1, 2025, Question 5 also would allow employers to administer tip pools that combine all the tips given by customers to tipped workers and distribute them among all workers, including non-tipped workers. Currently, only service employees, service bartenders and wait staff employees are allowed to participate in tip pools.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"missouri\">Missouri<\/h2>\n\n\n\n<p class=\"\">In Missouri, <a href=\"https:\/\/www.sos.mo.gov\/cmsimages\/Elections\/Petitions\/2024-038.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Proposition A<\/a> would raise the minimum wage from $12.30 to:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">13.75 per hour, effective January 1, 2025.<\/li>\n\n\n\n<li class=\"\">15.00 per hour, effective January 1, 2026.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">Annual inflation adjustments would resume, effective January 1, 2027.<\/p>\n\n\n\n<p class=\"\">Proposition A also would require employers to provide one hour of paid sick leave accrual for every 30 hours worked. Small employers with 15 or fewer employees would be required to provide at least five paid sick days per year, and large employers 16 or more employees would be required to provide at least seven paid sick days per year.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"everett-washington\">Everett, Washington<\/h2>\n\n\n\n<p class=\"\">In the Seattle suburb of Everett, Washington, <a href=\"https:\/\/snohomishcountywa.gov\/DocumentCenter\/View\/125251\/City-of-Everett-Initiative-24-02?bidId=\" target=\"_blank\" rel=\"noreferrer noopener\">Initiative 24-02<\/a> would:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Establish a local minimum wage of $20.24 per hour for large employers, effective July 1, 2025.<\/li>\n\n\n\n<li class=\"\">Phase in the minimum wage for smaller employers over the next two years.<\/li>\n\n\n\n<li class=\"\">Adjust the minimum wage for inflation every year.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">If enacted, Everett&#8217;s local minimum wage would be among the highest in the nation.<\/p>\n\n\n\n<p class=\"\">Everett would join several other localities in Washington \u2014 Bellingham, Burien, King County, Renton, SeaTac, Seattle and Tukwila \u2014 that also have passed local minimum wage ordinances.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column lnrs-hide-block-on-mobile is-layout-flow wp-block-column-is-layout-flow\"
