meetings.<\/p>\n\n\n\n<p class=\"\">The Board ruled today in <a href=\"https:\/\/s3.documentcloud.org\/documents\/25291496\/board-decision-amazoncom-services-inc.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Amazon.com Services LLC<\/a> that such meetings (which it defines as mandatory meetings urging employees to reject union representation) violate federal labor law because they:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Interfere with employees&#8217; rights to freely decide whether, when and how to participate in a debate about union representation;<\/li>\n\n\n\n<li class=\"\">Allow <a href=\"https:\/\/www.brightmine.com\/us\/solutions\/enterprise-business\/\">employers<\/a> to observe and surveil employees; and<\/li>\n\n\n\n<li class=\"\">Inhibit employees from freely exercising their rights because employers can compel attendance by threatening to discipline or discharge employees.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">The Amazon ruling overturns a longstanding 1948 precedent allowing captive audience meetings, <em><a href=\"https:\/\/casetext.com\/admin-law\/the-babcock-wilcox-co-6\" target=\"_blank\" rel=\"noreferrer noopener\">Babcock &amp; Wilcox Co<\/a><\/em>.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote has-text-align-left\"><blockquote><p>&#8220;Merely meeting with employees on company time no matter the topic shouldn&#8217;t be considered coercive &#8211; so long as there are no threats.&#8221;<\/p><cite>&#8211; Rob Boonin, Dykema<\/cite><\/blockquote><\/figure>\n\n\n\n<p class=\"\">Several states \u2014 including, most recently, <a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-news\/california-captive-audience-meeting-ban-signed\/\">California<\/a> and Alaska \u2014 already have enacted captive audience meeting bans of their own. Those state-level bans will remain relevant despite the NLRB&#8217;s new federal prohibition, as their scope and penalties differ.<\/p>\n\n\n\n<p class=\"\">The incoming Trump administration may seek to appoint new members to the NLRB who would overturn the Amazon ruling and restore the Babcock standard; however, it appears likely that Democrats will retain a controlling majority of the NLRB through at least mid-2026.<\/p>\n\n\n\n<p class=\"\">&#8220;This outcome was anticipated, and it&#8217;s a continuation of the Board&#8217;s initiative to tie employers&#8217; hands and mete out undue penalties, particularly in light of the Cemex doctrine,&#8221; Rob Boonin, an employer-side labor and employment attorney at Dykema, told Brightmine, formerly XpertHR. &#8220;Merely meeting with employees on company time no matter the topic shouldn&#8217;t be considered coercive \u2014 so long as there are no threats.&#8221;<\/p>\n\n\n\n<p class=\"\">The Amazon ruling undermines employers&#8217; ability to inform their employees on union issues before employees vote, Boonin added: &#8220;Educating them has long been respected as reasonable under the law. Mandatory meetings also avoid employees from having to face peer pressure from pro-union coworkers.&#8221;<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column lnrs-hide-block-on-mobile is-layout-flow wp-block-column-is-layout-flow\" style=\"border-left-color:var(--wp--preset--color--secondary-gray);border-left-width:2px;padding-left:10px;flex-basis:30%\">\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained wp-container-1 is-position-sticky\">\n<div class=\"wp-block-group is-nowrap is-layout-flex
