href=\"https:\/\/www.brightmine.com\/us\/solutions\/reduce-compliance-risk\/\">prepare<\/a> for potential disruption of H-1B visa case processing and adjudication after a new H-1B rule goes into effect on January 17, 2025.<\/p>\n\n\n\n<p class=\"\">The Department of Homeland Security (DHS) has announced a <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/12\/18\/2024-29354\/modernizing-h-1b-requirements-providing-flexibility-in-the-f-1-program-and-program-improvements\" target=\"_blank\" rel=\"noreferrer noopener\">final rule<\/a> to modernize and improve the efficiency of the <a href=\"https:\/\/hrcenter.us.brightmine.com\/employment-law-guide\/immigration-form-i-9-and-work-visas-federal\/10296\/#h1b-program-modernization\" target=\"_blank\" rel=\"noreferrer noopener\">H-1B program<\/a>, add benefits and flexibilities and improve integrity measures.<\/p>\n\n\n\n<p class=\"\">The amendments include:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">A revised definition of the H-1B specialty occupation;<\/li>\n\n\n\n<li class=\"\">Strengthened cap gap protections for F-1 students awaiting a change of status to H-1B;<\/li>\n\n\n\n<li class=\"\">Strengthened site visit authority for the US Citizenship and Immigration Services&#8217; (USCIS);<\/li>\n\n\n\n<li class=\"\">Clarification of the processes and requirements for amending nonimmigrant petitions; and<\/li>\n\n\n\n<li class=\"\">Codification of the agency&#8217;s longstanding policy of deference to its prior approvals.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">The H-1B nonimmigrant visa program allows US employers to temporarily employ foreign workers in specialty occupations &#8211; defined as occupations that require highly specialized knowledge and a bachelor&#8217;s or higher degree (or its equivalent) in the specialty.<\/p>\n\n\n\n<p class=\"\">In announcing the final rule, DHS Secretary Alejandro Mayorkas said, &#8220;These improvements to the program provide employers with greater flexibility to hire global talent, boost our economic competitiveness, and allow highly skilled workers to continue to advance American innovation.&#8221;<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column lnrs-hide-block-on-mobile is-layout-flow wp-block-column-is-layout-flow\" style=\"border-left-color:var(--wp--preset--color--secondary-gray);border-left-width:2px;padding-left:10px;flex-basis:30%\">\n<div class=\"wp-block-group has-global-padding is-layout-constrained
