diversity, equity and inclusion (DEI) initiatives are once again fully in effect.<\/p>\n\n\n\n<p class=\"\">Last month, a federal district court had <a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-strategy\/dei\/court-temporarily-blocks-portions-of-trumps-dei-executive-orders\/\">issued a preliminary nationwide injunction<\/a> blocking key parts of EO 14151, Ending Radical and Wasteful Government DEI Programs and Preferencing, and EO 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity \u2014 both of which seek to terminate and penalize workplace DEI programming and initiatives that the Trump administration considers to be <a href=\"https:\/\/www.brightmine.com\/us\/products\/hr-compliance-center\/\">illegal<\/a>.<\/p>\n\n\n\n<p class=\"\">But now a federal appeals court has restored the EOs while the case works its way through the courts.<\/p>\n\n\n\n<p class=\"\">In an order issued March 14, the 4th US Circuit Court of Appeals halted the lower court&#8217;s injunction. It said the Trump administration had satisfied the legal criteria for staying an injunction by showing, among other things, that it was likely to win its case.<\/p>\n\n\n\n<p class=\"\">With the injunction lifted, the federal government may once again:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Change the terms of, pause, block, cancel or terminate any federal contracts or grants on the basis that they are &#8220;equity-related,&#8221; as described in EO 14151<\/li>\n\n\n\n<li class=\"\">Require federal contractors or grant recipients to certify that they do not operate certain types of programs promoting DEI<\/li>\n\n\n\n<li class=\"\">Bring enforcement actions against private employers based on a provision in EO 14173 that directs the government to &#8220;combat illegal private-sector DEI preferences, mandates, policies, programs and activities&#8221;<\/li>\n<\/ul>\n\n\n\n<p class=\"\">But, as the 4th Circuit observed, neither EO ever defines DEI or its component terms. &#8220;As a result, it&#8217;s unclear what types of programs \u2014 formal or informal \u2014 the administration seeks to eliminate, and it could not respond to the district court&#8217;s hypotheticals about the same,&#8221; the order states.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column lnrs-hide-block-on-mobile is-layout-flow wp-block-column-is-layout-flow\" style=\"border-left-color:var(--wp--preset--color--secondary-gray);border-left-width:2px;padding-left:10px;flex-basis:30%\">\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained wp-container-1 is-position-sticky\">\n<div class=\"wp-block-group is-nowrap is-layout-flex
