{"id":9491,"date":"2025-07-03T20:15:30","date_gmt":"2025-07-03T20:15:30","guid":{"rendered":"https:\/\/www.brightmine.com\/us\/?post_type=resources&#038;p=9491"},"modified":"2026-02-04T12:17:20","modified_gmt":"2026-02-04T17:17:20","slug":"subminimum-wages-taken-off-the-chopping-block","status":"publish","type":"resources","link":"https:\/\/www.brightmine.com\/us\/resources\/hr-compliance\/wage-hour\/minimum-wage\/subminimum-wages-taken-off-the-chopping-block\/","title":{"rendered":"Subminimum wages taken off the chopping block"},"content":{"rendered":"\n<div class=\"wp-block-group alignwide has-primary-white-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-b5fc8583 wp-block-group-is-layout-constrained\" style=\"border-radius:25px;padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-7fc3d43a wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:70%\">\n<p class=\"\">by <strong>Michael Cardman<\/strong>, Brightmine Senior Legal Editor<\/p>\n\n\n\n<p class=\"\">The US Department of Labor (DOL) is abandoning a <a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-compliance\/minimum-wage\/dol-to-phase-out-subminimum-wages-for-workers-with-disabilities\/\">Biden-era plan<\/a> to phase out subminimum wages for workers with disabilities.<\/p>\n\n\n\n<p class=\"\">The Fair Labor Standards Act (FLSA) authorizes the DOL to issue special certificates &#8211; known as &#8220;14(c) certificates&#8221; &#8211; that allow employers to pay workers with disabilities at wages below the federal minimum of $7.25 per hour if their disabilities impair their earning or productive capacity.<\/p>\n\n\n\n<p class=\"\">Late last year in the waning days of the Biden administration, the DOL <a href=\"https:\/\/www.dol.gov\/newsroom\/releases\/whd\/whd20241203\" target=\"_blank\" rel=\"noreferrer noopener\">proposed<\/a> to stop issuing new certificates and phase out existing certificates over the next three years. At the time, DOL officials said they believe subminimum wages are no longer necessary because opportunities and training have &#8220;dramatically expanded&#8221; for workers and because employers now have more resources and training to recruit, hire and retain them.<\/p>\n\n\n\n<p class=\"\">But now, under the <a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-compliance\/employment-law-updates\/trump-administration-first-100-days\/\">Trump administration<\/a>, the DOL is withdrawing that proposal.
