Teachout<\/strong>, <strong>SHRM-SCP<\/strong>, Brightmine Legal Editor<\/p>\n\n\n\n<p class=\"\"><a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-compliance\/texas-employment-law\/\">Texas<\/a> has become the third state in the US to enact a law governing the use of artificial intelligence (AI). The&nbsp;<a href=\"https:\/\/capitol.texas.gov\/tlodocs\/89R\/billtext\/html\/HB00149F.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Texas Responsible AI Governance Act (TRAIGA)<\/a>&nbsp;sets broad overarching standards and protections regarding <a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-strategy\/hr-technology\/ai-in-hr-skills-hr-needs-to-leverage-ai-use-cases\/\">AI use<\/a>, with some that would be applicable to employers. It goes into effect January 1, 2026.<\/p>\n\n\n\n<p class=\"\">The Act follows the risk-based model for the development and use of AI systems for &#8220;high-risk&#8221; decisions relating to employment, finance, education, health-care services, housing and insurance. The law also:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-brightmine-list-item-spacing-small\">\n<li class=\"\">Prohibits developing or deploying an AI system with the intent to unlawfully discriminate against protected classes under state law. However, &#8220;disparate impact&#8221; caused by use of a system alone is insufficient to prove a violation.<\/li>\n\n\n\n<li class=\"\">Bans AI human behavior manipulation tools designed to incite self-harm, violence, or criminal behavior.<\/li>\n\n\n\n<li class=\"\">Prohibits using AI to classify people based on behavior or characteristics and assigning them a social score or estimation.<\/li>\n\n\n\n<li class=\"\">Prohibits AI systems from censoring or limiting access to&nbsp;political<strong>&nbsp;<\/strong>content&nbsp;or infringing on freedom of expression or association.<\/li>\n<\/ul>\n\n\n\n<p class=\"\">The law includes safeguards against the capture or use of biometric data without consent and specifies that consent is not granted merely because a person makes or post images or videos that are made available to the public (such as on social media platforms). However, a business may use biometric data only to train an AI system provided it does not identify individuals.<\/p>\n\n\n\n<p class=\"\">Companies that meet the Small Business Administration definition of &#8220;small business&#8221; would have no obligations under TRAIGA. The state attorney general has sole authority to enforce the law or pursue civil penalties and sanctions.<\/p>\n\n\n\n<p class=\"\">Colorado was the&nbsp;<a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-strategy\/hr-technology\/colorado-ai-law-regulates-ai-in-employment\/\" target=\"_blank\" rel=\"noreferrer noopener\">first state to enact a law<\/a>&nbsp;regulating the use of AI, with&nbsp;<a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-strategy\/hr-technology\/illinois-ai-law-in-employment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Illinois following shortly after<\/a>. New York City also restricts the&nbsp;use of AI tools&nbsp;to screen candidates or employees for making employment decisions, and&nbsp;<a href=\"https:\/\/www.brightmine.com\/us\/resources\/hr-compliance\/ai-laws-by-state-and-locality\/\" target=\"_blank\" rel=\"noreferrer noopener\">other states<\/a>&nbsp;have laws regarding the use of biometrics in employment.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column lnrs-hide-block-on-mobile is-layout-flow wp-block-column-is-layout-flow\"
