California employers with five or more employees should consider including this statement in their handbook to educate employees, including supervisors, about the availability of bereavement leave and to show their compliance with California’s bereavement leave law.

California’s bereavement leave law does not indicate whether the five or more employees refers to employees in the state or all employees. The more conservative approach is to assume that the law refers to the number of employees overall.
