In Thandi and others v Next Retail Ltd and another, an employment tribunal upheld equal pay claims brought by retail consultants who carried out work of equal value to warehouse operatives but were paid less basic pay. The tribunal found that the employer had failed to show that the difference in basic pay was objectively justified, reinforcing the need for employers to be able to evidence the reasons for pay disparities where equal value is established.
