Equal pay: No justification for differences in basic pay for Next shop staff

An equal pay case where retail staff succeeded in claims based on equal value work, with the tribunal finding no objective justification for differences in basic pay.

In Thandi and others v Next Retail Ltd and anotheran employment tribunal upheld equal pay claims brought by retail consultants who carried out work of equal value to warehouse operatives but were paid less basic pay. The tribunal found that the employer had failed to show that the difference in basic pay was objectively justified, reinforcing the need for employers to be able to evidence the reasons for pay disparities where equal value is established.
